need some help please

night before last a family member was busted at a checkpoint in texas while travelling from ca to fl. she was in possession of a package of brownies and butter. leo is stating her weight of possession including the weight of the brownie ingredients and the butter. that brings the total weight from 1 oz to 1 1/4 lbs. heh. what are the legalities here? does anyone know what amount she can be charged with? The difference with regard to the penalties is substantial.
Any quick help here would be greatly appreciated.

I've had something like this happen. Your lawyer will get that situated in court when they send out the butter and brownies for testing. For example my case was worse and was for that white stuff. I had over 14 grams but when it got tested they could only charge me with 9.5 grams because of the cut. That took me out of the 5 year mandatory sentence. I got probation instead. Get a good lawyer though that has lots of cases in that county.

get a good lawyer for her, if you can afford it. unfortunately the cops can charge whatever they damn well please... it wont be until a few court appearances that the actual charges will be figured out.... the court system is a slow moving beast. a good lawyers worth cannot be overstated. I never worry about a charge too much until im convicted n sentenced. (i have been charged lots n convicted ZERO). cops fuck up cases all the time.
if shes in jail, n u care about her... post bail n help her get a lawyer. no way she should be charged with an lb for some butter n brownies.... what a douche cop. howd they even know? edibles r the safest way to travel with thc in my opinion... sorry to hear this.. good luck

god damn this is infuriating! FOR FUCKING FOOD! these idiotic laws are so backwards...what are the actual charges? just possession, or have they added enhancements like transportation, intent to sale, how were they packaged? was any thing else illegal in the car? previous criminal record for anything marijuana related? you need way more specifics man, little details like having a scale, or having them individually packaged, can affect the outcome of this case...


but yeah like others said..LAWYER UP, and do your own research and bounce that off the lawyer as well, look for previous cases regarding possession of edibles.. have the samples tested and that will give some nice delays and cut down final weight...


also can you tell us more about the checkpoint?? here in california there is a checkpoint at the oregon border, but its for agriculture and those guys barely do anything, they dont even look inside....i know they have checkpoints from mexico-texas but didnt know they had from new mexico to texas...

ya the Cali agri checkpoints are total bullshit. Nothing ever goes down there and I've even seen non cops doing it. There is one coming back into Cali from vegas.

To OP, most important thing here is getting family member a good lawyer. You are going to spend a lot of money, and you need to accept this now if you want to try to spare her jail time.

Also for anyone else considering cross country drives with pot, the south is NOT THE PLACE TO BE DRIVING. The south fucking sucks. Checkpoints everywhere, terrible laws etc. Even if you are driving to Florida I would still take a middle route vs southern route.

I'm real curious how this bust went down. Even with a checkpoint, how did they find out about brownies??? I assume at a checkpoint they can choose to search the car with or without your permission (reason number 212346523 why you shouldn't drive thru southern states) so I guess they decided to search her and somehow found them and smelt it and could tell??

Unless you can't afford a real attorney, you should be able to beat it.

^^^^^^ I am sensing a common thread here!!!!! Buy the best mouthpiece you can..check for former prosecuters who have a hard-on for his/her replacement or one on the good ole boy network....Right does not matter..winning her freedom does...

aint that the truth, it seems that your choice of lawyer means more than what you are accused of doing. Justice for all (that can afford it)
