hello every1 i need some true experince advise on a situation that arised ok heres whats up.

lets say your son when he was 14, several yrs ago was cought with less then a bowl of canibis at a skate park. ythe marshal released him to me from the park and he was handed a ticket. now we as parents went to juvi court on the day was supposed to, we go to the counter to check him into court. ok now the lady behind the counter after about 1hr called us to the window and say. srry no paper work turned in, so she marks ticket as places a phone numberon it and says call back next month. well as being a good parent 1 month to the day i called and they again said no paper work turned in. tell him stay out of trouble and have a nice life, since this incidient he was in trouble for school no warrent. he has had 2-3 address changes on his state id no warrents, went through a compleate 50 state ncic back ground check few months back nothing no fn warrent. last night on his way home from the store he was pulled over id'd and the fn warrent showed up wtf is this crap. now as good parents we even saved this ticket from 2003 on the ticket is no paper work wrote on it along with the telle # for us to call. now we though this was all taken care of so has any here every experinced this or know some1 whom has ???. i'm sure i have enough time to finish this crop out dose this sound like we should be abel to have this crap dismissed and if not dose the probation officer have a right to search the whole home or just his room thx for your help peace and be safe

never been in this situation nor know anybody who has...now i am assuming he just got pulled over for speeding or somthing and didn't have anything in his car...if this is the case and there are no new charges I think if you hire a good lawyer for him the case will be dismissed and you won't have to deal with any probation officers...btw i would think the po, if he did visit your home, would only have access to his room

consult a lawyer...norml has links to good lawyers in each state

good luck with the situation

If you haven't already, hire an attorney.

You are sure the warrant was for the 2003 possession charge? Maybe he got into some other kind of trouble that you are not aware of. What I find interesting is the huge amount of time delay here and makes me suspicious that he got into some other kind of trouble. The more documentation that you have to back up what you have said here will help tremendously in court.

Did you make a printout or save the NCIC of the warrant search you did awhile back? If so than that would be very helpful here in showing that to your knowledge, he had not warrants.

The original ticket marked "no paperwork" is going to be very helpful in court as you will be able to show that you acted in full faith and compliance with law.

In my experience, you have to go to court, be formally charged and sentenced THEN your probation officer (PO) is assigned to you. It may be several months before your son even has a court day. I have never heard of probation officers visiting a house. Even when my friend was on house arrest his probation officer would just call him. He was still allowed to go to his probation meetings and they never came to his house, ever. I would really like to meet the PO who has time to go to clients' houses!

As far as if they have a right to come to your house, that would be a good question for the attorney. I can't give concrete advice but intuitively it doesn't make sense that they should want to come to your house. They have HUGE caseloads and your son will be one of many.

Good luck!

No worries bro, they just want the revenues your son hasn't paid yet. How it could go from a ticket to your son that sounds like wasn't handed in forever, to a inspection of your home is beyond me

1. Lawyer up instantly.

2. Do not tear down yet.

3. If probation officer is assigned, tear down immediately.

I had a similar issue, got a DUI when I was 18 in the state I was in college, but had a license from another state, never had drivers license in the state I went to school. Did the rehab, probation, paid every fine, blah blah blah. Almost eight years later, when I went to get my license renewed in my home state, they tell me there is a capius for me in the other state.....had to hustle to pay a fine for re-instatement of my license THAT I NEVER HAD ANYWAY.....fooking system

good luck brother

depending on your state, there are limitations for how long the police have to file the ticket correctly. Like othershave said, you probably should pony up for the lawyer to just make sure stuff goes away nicely. Not sure if you know this from experience or not, but i'm sure you've heard it before. You get a lot more respect and usually a much easier time if you actually bring in a respected lawyer. The more experienced the better usually, as guys who've been in it for a while and been successful usually know the DA and or judge personally and can be good at ...moving stuff along...at least IME

right on every1 thx for the replys as i stated he was 14 when he was cought try to roll a joint at the skate park. when i showed up all the canibis they had {cops} amounted to maybe a half small bowl few crumbs really. when i showed up to get him from the marshall at the park. of course i played the highly mad but maintained adult long hiar full beard onto my chest lol when i went to get him. i discussed his punishment with the marshall and my son was released to me with just a ticket. funny thing cops took the few crumbs dumped it into a test kit it turned blue cops was like yep good stuff. now it was everything for me not to bust a nut laughing turned blue for canibis yea. but anyways went to court no paper work was turned in the ticket was marked as that by the juvi offical behind the counter.i was told call back next month this date which is also marked, now at the time i was rolling 3-5 pounds a month so dam skippy i was maken sure this was taken care of. made the call was told by same person no paper work still tell your son stay out of trouble and have a nice life. so i as a parent thought matter has been resolved remember this was when he was 14 now he's 19 was in trouble for not going to unsafe schools we have here. seen a PO instead of a judge had to have teachers sign his paper. then each wk we had to return signed paper to her office at juvi. no warrent then he's had 2 address changes on his ID since then and his current job done a full NCIC back ground check before they hired him for his current job. no warrent

now heres another question i have maybe some1 could shed littlelight. on the paper from the reciept from postn his bail this morning it says his violation. possess les then 1oz canibis {marijuana} and then the citation# this number dosent match the original ticket citation number arent these 2 numbers supposed to match ??? the original citation# is no where on the reciept for bail

again thx to all my oldest son is workn on his friend who runs escort services lmao to see if his lawyer will handel this as a favor.

again thankyou very much i'm not trippn yet and really dont plan to my current flower run will be done 1wk before he gose back to court this all just dosent seem right

on a side note as for other trouble i didnt know about nope i know this for sure 100% sure. any other trouble as a kid i would been told by juvi gettn a call we have your son, or even after he turned 18. and reason is he knows i grow and honestly would jepordize my grow he dosent run around hasnt since 14-15 yrs old. back then he was an outright punk but used his brain for the most part and now he's turned into a proper young man of 19 years old.

Hire your own lawyer, not one doing it as a favor. Trust me on this. Whoever said an experienced lawyer knows the judges, prosecutors is dead on. It wont get you off but helps alot.

I think in the end it will be dropped but you need someone who knows the system.

One issue is he was a minor. How is he going to be punished now as an adult for a crime he committed as a minor? Are they going to send him to juvi???

having a pimps lawyer wont look very good lol
actually this lawyer is very respected he's not just a lawyer for this escort service he's a major criminal lawyer :)

from what we have been told he needs to get a copy of his back ground check from few months back the original ticket and everything should be dismissed. i really dont feel like shutting my grow down so if worse comes to worse a dead bolt gose on my bedroom door and will be locked 24/7 weather im in or not. i know i know but the po if he has to have 1 will only look at the livingroom and his room because he as acess to them parts of the home. a dead bolt stops acess to my room per the lawyer, because i do own few firearms. and they wont be leaving the house 1 of my shotguns is almost 100 yrs old and was given to me when i was 8 yrs old i'm 45 next month :) i know i know growing with firearms just another charge ifn they ever come for me.

thx every1

i doubt they are going to have a PO doing house visit for less then a G on a 14 year old, but hey i don't know your area. i had a good buddy on fed probahation for a clorox bottle of liquid L at a dead show in 94, he did ten years and when he got out was on probhation actualy still is. his Po used to visit him randomly and they would bust his balls for high times magazines and incense and so on, they were real pricks. however i would imagine as the father of the household your son is mearly a guest in your house and at 18 you could justifiable say he rents a room and that that room is his only stake in the palace. anyway i doubt you have much to worry about, stay safe.

This tells me it is one of 2 things-- Either a mix-up in paperwork, which will be easily discovered by the Court...or he had another charge somewhere--
Either way, you should be fine--

Maj, I was having a hard time following some of this. Is your son now out on a probationary release and living with you?

LOL, its a little confusing.

Basically a ticket for possession that his son received many years ago, has resurfaced. He is worried what happens if his son gets probation.

Hire a lawyer? The time has passed for this. Here is another case of tyranny at your doorstep, what are you going to do about it?

We're so whipped by the legal establishment, it is time to remove the chains. Hiring lawyers to defend you against other lawyers, both of whom are part of the same club which serves no purpose but extract money from you.

You need to educate yourself, and your son needs to do the same. You should represent yourself fully against these charges from 2003. Take it to trial.

Enough of this shit. "I got busted, what should I do" The response? "Hire a good lawyer"

How about this? Defend yourself on these unlawful encroachments upon your liberty.

They wanna try you for growing, possessing, whatever, let them. Now defend yourself. Hiring a lawyer is NOT part of that equation this day and age due to the corruption that has grown around the profession.

It is time to stand up and FIGHT!

YOUR CRAZY BRO. that is all well and good in ideolog heaven, but in the real world you bes get yourself a lawyer. you don't know the ins and out of the court system and will only end up getting bent over even more if ou try and go at it yourself. you my freind must have never been in jail, because if you had you would realize a good defense attorney although maybe being a crooked pric, is your crooked pric and works for you. history has proven that defending yourself is a bad idea. I agrea withj you in principile and i hate the system just as much as the next guy, but when your in it you want a programmer who can help you navigate the matrix.
