I have just read the 30-page decision from Judge Marilyn Hall Patel, of the San Francisco Federal Court.
There are only two charges left against Eddy Lepp.
I spoke to Eddy yesterday about his case, and although he was in considerable pain after a double-hernia operation (the same day as the judgement's release), he is upbeat about the case for many reasons.
Firstly, the two remaining charges have been separated into two distinct and separate cases..
A - the fact of the 24,500 plants (the number keeps changing...!) in and of itself, although evidence pointing to their existence is non-existent. The judge ruled the warrants and evidence as inadmissable due to many errors on the part of LEO. (Wrong address, wrong house surveilled, admission of illegal search by local LEO's, etc.) So we wonder how the Feds are going to prosecute someone with no evidence at all?
B - the matter of a pound of pot being sold to an undercover agent thru a local Confidential Informer named Ben Tennenbaum. I would post his picture here, but was not allowed to take any photos in Federal Court. Again, there is no evidence that Eddy was involved, except for a tape recording with Eddy repeating endlessly that he had nothing, the Feds took it all, and his refusal to sell the man anything - all on tape. And it's the only evidence the Feds have (silly little thing called DISCOVERY - where they have to reveal all the evidence against someone before they can take you to trial).
I spent time going to the last four hearings on this case, so I have a first-hand account of the proceedings.
My advice to all who grow, know the law, use it to YOUR advantage. Remember, that's what THEY do to you. The law CAN and will protect you if you know it. It's basically the same old wise advice from the ages - KNOW YOUR ENEMY.
When I hear more about future hearings, judgments, etc. I will post it here.
