more plants...more time?

I've got a silly question.....if I had 12 plants growing.....and I got busted.....would I get in more trouble then if I only had 4? If those 4 were trees and the 12 were SOG.....would it matter? Just wondering....

even iii know the answer to that one. Refer to norml.org where they show the laws for each state, including the various levels of shit you can get into. some states go by number of plants but I think most go by weight. They do weigh it before drying and WITH soil usually from what I hear. And they step on the scales to get more weight. and water the pots too. In most states, cultivation even of a sickly single plant with yellow leaves and no buds = a felony. I think you can thank Republicans like Newt Gingrich (who proposed the death penalty for pot traffickers) for that.

This is an important issue for bigger grows. The federal charge is "manufacture of marijuana' and it starts at 100 plants calculated at 7 ounces per plant, cuttings, males seedlings, everything counts.
Even then usually the state charges you instead.
In the district I live, the feds step in at 500 plants or more and that will get a first time offender 30 months minimum.
The difference between the feds and state is with the feds you will do the time. With this charge add 4 years supervised release after release from prison.
But for 12 plants...expect a firm slap on the hand.

Color me paranoid but, if 4 will cover you, I'd do 4. I used to do a 24 plant SOG. When it was perpetual, I might have as many as 50 plants at a time between clone chamber, veg chamber, moms and flowering. Now that I'm ScROGGing, I top out at 4. Usually it's just 1 in flower and a Mom. Occasionally, I'll take a couple of cuttings but, these replace the Mom or the flowering chamber and then I'm back to 2.

Maybe I'm naive but, I like the idea there's nothing about my grow that says sales.
 
Keep it under 100.

In most states, the guy with the best attorney gets the best sentence. For instance, I've seen a guy with a public defender charged with felony possession recieve 5 years probation (They busted him with four ounces). Earlier in the day, they'd given a guy charged with cultivating 80 plants two years probation, because he could afford a better attorney. (Neither had prior arrests.)

It's really twisted, but like everything else, the legal system is fueled by money.

prior arrests is the key thing, imo. first time offenders are just that. they take that into consideration.

snipped off branches hastily stuck in dirt to be photographed can up your plant numbers fast.....you should hope your state uses weight instead.......a cop can only make a plant and rootball weigh so much.....

keep it under a 100 so you don't go fed. other than than, yes, in most cases more plants = more time. SOME states go by weight, BUT these mofo's ain't hanging and curing before they check the scales...

my lawyer tells me its about weight, and hes given me variouse 'weight' limits to adhere to inorder for him to be able to provider services for me. im sure the cops took photos when they busted you, and the lawyer you get will probably get a copy, and then he can argu the fact the there is no way on gods green earth thoes 11.8 gram plants are worth $5,240 like the DEA insists. court is actualy filled with an amazing amount of logic, you can argu any ground you fucking want, it just might now work if it dosent make sence to a jury of peers. remember jurries CANNOT be punished for there verdict, get the right lawyer and you can set new PRESIDENT on anything....

Sometimes trial court can be a pain in the ass. Trial judges don't like to throw out evidence. They normally have close relationships with the prosecutors, and both have career-incentives to get along. ("If you scratch my back, I'll scratch yours")

Don't give up, I've seen more cases thrown out in the appeals process, than in trial. Most of the logical judges get promoted into the Supreme Courts. The trial judges should be punished for their stubborn incompetence, but aren't.
