Even in California you know what towns or counties not to play around in. You have to look before you leap. The judge and prosecutor know how the game works. Give a guy a ridiculous sentence and it attracts outside media attention. That attention brings in outside groups to represent the man and mount an appeal. The attention brings in outside money into the county and court coffers. The judge and district attorney get free campaign advertisement for the elections next year. Every Cannabis user in jail or prison is a political prisoner. They are their for somebody else's benefit. Its a game they play in every jurisdiction in the country. It pays to understand the rules of the game before you get in it and become a pawn.

I read all the comments on the Times Picayune website and one was from the defendants lawyer. He said the jury ruled 10-2 and was obviously not unanimous. I don't know if the jurors wrote in anything besides "not guilty" but I thought you needed a unanimous jury to convict in a criminal case. Other comments said the judge had nothing to do with the sentence. His hands were tied by the law and the DA was to blame. The defendants lawyer said the DA did not even offer to plea bargain and the trial lasted all of 2 hours. Willie Nelson got popped in Louisiana with over a half lb after previous arrests and got off which I am glad. I just wish if we don't legalize we could at least get treated like Willie.

this is not cool at all. not even any weapons or violence. if it was meth, heroin, or coke/crack, i would say its a harsh sentence, but not insane. life for only selling cannabis, thats insane, talk about a old school republican judge
its insane how many coon ass' smoke. hell i remember when they tested a few of the oil rigs in the mid 80's. pretty much everyone tested positive except the helicopter pilots(their rartio was only like 25%)
needless to say everyone kept their jobs.

On tonights Rachel Maddow show she showed that the USA had the highest prison population in the world,we have more people locked up than China. Anyway, when you look at the numbers, which state has the most etc. The further south you go the higher the prison population. Culminating with Lousianna as the state with the most people per capita locked up. And the states that border Louisiana are the next highest.
These states also have the highest numbers of privately run prisons for profit. The more people in jail the higher the profits. It's pretty fucked up to say the least. So life as a prison slave for a couple lbs of weed.

i feel you on that brother, even tho i am one of those people that bitch and i dont vote...but the political parties in my country dont have platforms that are even worth voting for....so its a real dilema for me. all i do is just listen to em and wait for the appropriate time to cast mine. one or two politians were on the 'decrimilization train' but soon got off when other opportunities were presented to them which were in "conflict" with decrimilization.......i was like wtf?! *sigh*.....our current goverment is absolutely fuckin up the country and the only thing keeping me sane at the moment is....at least i didnt vote the fuckers in......what a life lol

This is a post from the defendant's lawyer on the case taken out of the comments section on the article posted from the Times Picayune:
"I represent Mr. Hood and I am not a public defender. The fact of the matter is that the State never offered him any sort of plea. For some unexplained reason, the DA was hell bent on giving him a life sentence. Judge Childress had no choice. Once the DA files a multiple bill and proves that Mr. Hood has two prior convictions, the judge has no choice. If Judge Childress had discretion in the matter, I am sure a more appropriate sentence would have been applied. The real bad guys here are the legislators who continue to take power away from judges and give it to the District Attorneys. Even the jury was conflicted. Mr. Hood was convicted by a 10 - 2 verdict (yes you can be convicted by a non-unanimous jury in Louisiana). It is time that the people we elect as judges be given the power to hand down sentences based upon what they observe in court."
