What exactly determines if they can seize your car

what if you got caught selling an ounce but you weren't in your car, although the car is parked at your residence?

im not 100% sure, but if the vehicle was used to transport to make the sell it can be seized.............a friend drove an ounce to sale and parked his car down the street from the house and they took it

Maybe a question to ask a lawyer familiar with your state laws regarding the above.

There you'll get legal advice instead of just opinions...

it really depends on how much of an ass they want to be. They can seize anything they want, if they claim its profits from selling drugs. I have a ton of stuff I am trying to get back, cars, etc. Hell the car has a lien on it, they cant keep it, the bank owns it, but they still are being dicks and wont release it, and thats with one of the best lawyers in the area fighting for me. And the car they still have wasnt used for anything or near anything illegal.

But in reality, this was way more than an ounce, and for a couple ounces of weed, they probably wont bother doing anything.

They (local, state, and federal LEO) can seize anything they want any time they want for any reason. You do not need to be convicted of a crime, nor even charged with a crime, nor even arrested. The property itself is charged with a civil offense, not a crime. And unlike a human being in a criminal court, it is up to you (a third party) to prove that your property (the defendant) is not guilty. Gotta love the good ol' U.S. of A.

Of course whether or not they will actually seize any property is anybody's guess. Is your car paid off? Is it worth a lot? It's really all about the money. They will only take something if it can make them money. If your car is worth something to them, then seizure is a real possibility.
 
if you have a loan on it, then they wont make money on it they wont seize it if its a lease. if you own the car and they execute a search warrant most likely they are taking it. if your house has a loan thats greater than what its worth they wont take that either...according to my attorney they have to pay for it if it has a loan on it! if you do own the property or the car...they search either or and you have taxes to prove your employed they wont take your property. but if not they will take it. just my 2 cents with the legal laws and what ive gone through so far.

they will take what they want, loans/liens dont matter. Can they keep it is a different story. I had 2 cars seized that had liens on them. One car the bank fought and got it back, repoed it from the impound yard, sold it, and stuck with me with an $11,000 bill for the shortage.

Second car has a lien on it and they still wont give it back after 6 months. It just sits in the impound yard. They cant keep it, its just a matter of when they decide to "release" it. Its upside down, they could pay the loan off and keep it, but its not worth it. So it just rots in the police yard

Everything Tony said is right.

Doesnt matter if you have a job or not. I have tax returns personal and business, etc showing where I made most of money. Cops saw it, they searched every piece of paper I had in my home office, tax returns were a whole drawer. But in their staements, they said they saw no proof of jobs, or a business.
