legal argument against california dispensary shutdown

I know this, but did you read that article? This came down as a unanimous ruling by a state appellate court, and they're saying very explicitly that a city can regulate a dispensary if they LIMIT its operation, but may not regulate by PERMITTING its operation.

This whole thing is going to be in SCOTUS...it is going back on the Federal Law trumps State Law thing--
Altho now, it will be viewed by most, as an attack on State Sovereignty--
As far as why they didn't use SB420 to counter it...simply because they are saying Federal Law trumps State Law, so bringing it up would be moot--:tiphat:

It is an attack on state sovereignty, but it does not help one iota that one of our own appellate courts found against a governmental body within the state.

You can regulate IF you limit, but not if you permit. Yet, according to state law (according to you) we're permitted. I haven't read the actual ruling itself.
