Legal advice needed lawyers & nevadans welcome.

Hello all I need some legal advice on the following I have a older friend with cancer and he is registered in nevadas mmj program and all legal he does not grow currently but allowed up to 4 mature plants. He is in bed or sitting 24/7 because of his condition he cant really take careof a sm grow let alone his daily activities.

He smokes too much to be buying off the streets since there are no nevada med clinics he is forced to do so or he can grow his own but his health limits him so this is where I come in. I have no doctors rec or not registered with nev mmj program and have no plans to do so because I dont qualify.

My plans are to build and construct a safe grow space within his residence to nev law. and then will be stopping by on a daily basis to care for plants. That is pretty much it I will be paid monthly at a set salary via personal check. no buds no cash no favors.

My goals are to be able to file taxes on this money,so will I have to do 1099 work??
Ànd could this land me in the slammer for cultivation?? even though its not my property
And could prosecution be avoided as long as I dont see or handle any mmj??
And his wife really wants me to be totally legal he does not mind as much could she be my demise??

You can help him. It's his setup you're just helping him along. You can work out whatever kind of deal you want with him but I"d be damned if I'd 1099 it or claim it. How would you explain that and keep the attention off your grow? IRS is a bitch. Sooner or later they will look into what you have going on. Especially with the new 15000 IRS workers the health care bill set up to scrutinize everyone income for health care qualifications. Do the work, take cash only, and tell his wife your security comes first as she's wanting the attention on you..
There are dispensaries here but they are about the same as street prices and in some cases much, much more.

Thanks resinryder nice to see some locals around here:wave: and I would not file it as "MMJ related work" simply 1099 residential home repair. And the only reasons I would like to file are number 1 looks like I have a job 2 no need to explain to others where the $ came from 3 I can have something on the radar because right now I do lots of side work besides mmj related and im paid $ under the table therefore never file. And thats crazy 15000 new workers..whats next?:spank: And quite honestly I probaly wouldnt do it if the couple havent poped the question to me. But in the end like always I probaly wont I was just considering it. And can you please send/post the addys on the dispen in NV my silly ass buddy said there was none in LV never really looked myself. Thanks man peace

I may be wrong but he may/may not be entitled to file a form also if you are filing a 1099 against him. I would really look into this with a tax specialist.

I have done side jobs in my line of work and the only time I filed a 1099 was when the business I did the job for claimed my work so I was forced to do a 1099. The 1099 would just show up in the mail and the problem with this is if the money gets large they may want to see receipts. Also the 1099 will cost you about 40% of your take home so keep that in mind (i.e. $100 nets you $60) in my state anyways.
