Laws on Glass Sales

Im setting up an online head shop, and I'm having a hard time figuring out the state by state laws for this. If I clearly state on an entry page that its for Legal Tobbacco Use only and Must Be 18 to enter, and all that good stuff, am I still breaking the law? I figure if I follow the same ettiquete as most headshops do, Im within the guidlines. Is there different laws for sending glass from one state to the other? Is their certain states with stricter laws? If anyone has a good source of information on this I would appreciate it.

Im not too positive on online shops but i know the state im in headshops only last a year or two before the government comes in. They literally just took everything out of the shops besides some t-shirts. I'd check out NORML and see what they have on it. But if your going online you probably will have an easier time if your based in a more mj friendly state i would think.

Im based in California. Around here, they only mess with headshops once they start making millions. Like Chong glass status and all that. None of the little guys get fucked with.
 
In my state if it has a carb on it...it is considered illegal...so I would make sure you find a place to check every states laws regarding this.

Yikes! Thanks for the heads up on that. Thats what Im looking for is a place to state the laws for every state. I was looking at similar stores in Oregon and California, and they didnt appear to have any limitations on which state it was shipped to. What they did have was a disclaimer stating its up to the customer to distinguish the laws of their state and the store is not held responsible, something like that. If anyone has a site that will help me let me know! I tried checking codes, and regulation site and I cant read through all the penal code legal mumbo jumbo nonesense.

You are going to lose either way when the time comes to look for you. Shipping from state to state means you'll be liable for federal laws/charges*. I think the last guys that got popped in operation pipedreams just got done doing their 36 months federal time. The states they got busted from I know for sure are Iowa and Pennsylvania.

*21 USCS Section 863. Drug Paraphernalia [ federal law on the books ]

They also list operation pipe dreams as an ongoing operation. Even most of the local headshops around here that have webpages wont show/list any glassware.

Thanks for the knowledge Verite. Fuck the fucking feds. Im still gonna bring good glass (at a good price) to the people. They cant stop me. I just dont want to fuck with states that are gonna take my head for it, if you know what I mean. Sounds like Iowa and Pennsylvania are gonna require some stipulations upon order. This is the kinda info I need. Keep it coming folks! Stay irie!

We have a tobacco license, and a buisness license. So by saying it is for tobacco use only would keep it in line with the law, according to this, correct?

You're gonna have to hurry though before tobacco is illegal - they outlawed cigarette smoking on hiking trails outdoors and in your car or anywhere in public - even the author of the original initiative for safe non smoking work enivronment rules has done a 180 sided with smokers and stated that those that wish to force their will on others have taken over the movement and it's gone way too far. In some states you can legally be evicted if you are caught smoking on premises, even in your own apartment/home. All it takes is one wealthy asshat with political friends......one governor even got a $4 per pack tax pushed through this year, bringing a carton of smokes in her state to $78 - not to mention the "Use Tax" that will take the total over $90 per carton. All with heart and cancer coalitions lobbying to force their will on others - a true democracy at work.

Get caught in our state with a piece of glass and it's gonna cost you $200,000 plus legals fees. BTW this asshat prosecutor spent over 3.5 million tax dollars on getting this piece of shit bill passed, and the only distinction between "drug paraphanalia" and tobacco useage is whether or not you get busted with tobacco or pot.....I'd worry more about the tobacco gestapo, personally - some states are constantly trying to push bills through to ban tobacco sales outright and IMO it's only a matter of time before it gets slipped in with some other bill of political import. Smokers are among the endangered species list, I'm afraid. Praise the Lord. :nono:

Yeah, its a bunch of bullshit. Im sure someone will find a way to piggy back it on some other bill, like they did with herb way back when. Got damn shady politricks!
