Lake County Supervisors Restrict Access to Medical Marijuana in Proposal

Lake County California's Board of Supervisors will meet on Tuesday, April 27 to consider yet another draconian proposal to restrict access to medical marijuana.

Attached is a pdf document with the entire text of the proposal, which this reporter has read. The contents will make you weep when you consider that almost every collective and cooperative will be affected by these rules.

The board would make almost every one of these establishments to move outside inhabited areas, and severely restrict the number of patients, amounts of medicine available and in some cases prohibit cannabis production for medicine. ALL edibles would be banned under this proposal.

Please take the time to read this travesty, and make time to attend the BOS meeting to stand up and tell the Board why this proposal is a bad thing for medical patients.

Wow... I am pretty floored by this draft. I need a little time to digest. This will basically criminalize almost every outdoor grow in Lake County.

This ordinance really sucks!

100 sq.ft. maximum indoor grow with 1,200 watts maximum light for indoor grows. 12 watts/sq.ft. That'll grow a lot of good meds - NOT!!! Regardless, wouldn't this constitute an unconstitutional limit on plants as per the Kelly decision?

The real kicker is the hold harmless provision. To get their permit, the county essentially says you have to give them the right to falsely imprison you without recourse.

What a crock! Good luck at BOS meeting you guys & gals!

On all fronts, both for growers and dispensaries, this would be a disastrous setback.

PharmaCan. Thanks for pointing that out. I will research it and consider it for comment on Tuesday. I am just trying to digest the legalese... any help is appreciated. I am forwarding this to a lawyer in San Fran to look at.

This ordinance can't stand. Just the indemnity clause alone should render it null & void.

Essentially, the county is saying we can set all these laws down and you can't do anything about it. You can't sue us.

Another thing that really is over the top is the record keeping & reporting requirements. Patients have a right to privacy. A "request" from the Sheriff shouldn't be sufficient to hand over people's personal medical information. It should have to be nothing less than a subpeona before info is handed over. A judge should review the need to probe patient records.

Is there ANY other business in Lake County subject to such onerous requirements? Such intense oversight directly by the Sheriff?

Oh, yes, and don't forget the Sheriff wants to know the location and owner of every grow a dispensary buys from. You gotta love the gall... Don't forget to CC each one to the DEA!!!

When does this go before the BOS? NEXT TUESDAY, the 27th! Everyone and I mean EVERYONE should show up and show their displeasure in front of the BOS. We can't let them get away with this.

Good thing elections are coming. Everyone take note of each Supervisors stance on this issue and vote appropriately.

...All I see is them saying the out door needs to be behind a fenced locked gate out of sight from neighbors homes and away from streams..isn't that standard operating procedure...I like that they won't let people grow indoor either unless a building inspector comes to check the ventilation and climate control system of the indoor room. The 1200 watts per room thing is probably due to them being uneducated about the way indoor grows are done. Maybe if the community educated them in a non confrontational manner you would be able to get a permit from the county much like Canadian MMJ farmers get for their indoor and out door grow rooms...Seems like all the grows that will be affected are the unprofessional ones. I would be happy to go get a permit today for my garden site if I was to require one and I'd feel confident I would pass. Everything is done up to code already in case of any legislation like this by my county which they have tried to pass in the past, and failed to do...Good luck to my brothers and sisters in Lake Co in coming to a happy medium with your community and our rights guaranteed to us to have MMJ which we earned by using our power to VOTE the same power that put these supervisors in to place!! Don't forget that! The power is yours!
 
60 square foot max for one patient, 100 square ft for 2? 1200 Watt max indoor? I wonder if this is their way of getting around plant limitations..... I will be watching this one closely

And what happens to this ordinance once we vote to LEGALIZE it?

I think they should hold off any consideration of changing the law until after the elections in Nov.

Of course then we wouldn't get to vote out of office those who are for this bill.

Planty: you're missing the part about the records that will be kept, zoning permit requirements, records, property size requirements, distances from property lines, plot sizes, and a bunch of other things. Backyard growing would go down the tubes.

If you are in Lake and you support MMJ, Rise up. Make it to the meeting. I will.

Legalization is not for med use, but I wonder if you could have your med grow AND your non-med grow on the same property? Muahahaa

anti MJ forces are on the march
if legalization does not pass this Nov., then i expect you will see even more of this activity
i'm sure even if it does pass, there will still be plenty of anti MJ activities
but the defeat of legalization will give a surge to anti MJ, they will not be content with just the defeat of recreational MJ

These people are dumb as shit. They actually think that edibles shouldn't be sold to med patients. I really don't see how anything that they get passed will do anything but get overturned by a higher court at the first opportunity. These regulations are specifically contrived to eliminate the dispensaries in the area. It's stupid.

This is not going to pass on Tues but we need to all join together at show them we are united against this proposal!
Please Get Up Satnd Up on Tues At 10 A.M. In Lakeport!
We need them to see what a huge force we are!
