Richard Nixon officially declared a "war on drugs" in 1971

The President can not declare war. Only Congress can declare war according to Article 1 Section 8 of The U.S. Constitution.

So is The War on Drugs Unconstitutional?

Just about everything the US government does is unconstitutional at this point. They have completely torn it apart, used it to wipe their ass as they have taken each individual god-given right away from the citizens. The war on drugs is simply in place to protect the profits of Big Tobacco, Big Alcohol, Big Pharma and the Timber industries.

well there might be more, this is just a hypothesis but.. drugs being illegal have way more value, so, more money made, more money spent, they seize proceeds of drug crime, people get sent to jail, lawyers are paid, judges are paid, cops are paid... prisons are built and in the us I think the prisons are privatized.. so incentive to make them.. wardens, guards, bus drivers paid

a lot of people are living off the war on drugs, criminals and non-criminals

Yes unconstitutional. The Constitution exists only as a figment of the populaces imagination though IMO.

The classification of cannabis as a schedule 1 controlled substance is illegal and any pursuit of justice against individuals by the Federal government on behalf of this illegal classification can/should/will be over turned.

The US Health Department, on behalf of the US Gov't owns the patent on medical treatments derived from cannabinoids.

To classify the substance as having no medicinal value, then patenting the medicinal use of the substance, the Government once again takes a blatantly hypocritical approach to the prosecution of individuals using the substance for a purpose they very well acknowledge works.

Constitutionally speaking, the Federal Government is also outlawing the germination of a seed. It is paramount to saying "it will not rain on Saturdays." They have no control over nature and to try and impose themselves against a free individual and their right to enjoy everything the natural world has to offer they defy the right to the pursuit of happiness. It is this fear they have constructed which allows them to "bend" our rights of privacy and freedom.

Vote Libertarian. Liberty, and Justice, for All. I am the master of my body and my destiny. Not some fat legislator I'd as soon nut check as respect.

Interesting question.

I would wager that in some ways it is. I would look at pain as being a central nervous system response to an external stimuli. The mind is capable of pushing the body far beyond what we may assume our capabilities are. At the same time the pain from a broken femur bone is real.

What happened with drug criminalization is clearly an abuse of power by federal government bureaucrats.
The Constitution is a document that defines and constricts the range of concentrated governmental powers that our founding fathers feared. Our govt is being ........ and has been........... HIJACKED by people with a lot of money and special interest groups and businesses with a lot of money.

Our founding fathers feared the corrupting aspects of concentrated power, much like the Romans did generations before. We all know what happened to the Romans, the greatest democracy that people ever created on this Earth. Rome degenerated into a DICTATORSHIP of emperors. Why? Too much fucking wars! These guys went out of their way to limit their leader's power. They failed.
Just like where the U.S.A. is heading. The war on drugs, the war on terror, the war on communism, etc. It appears that War and Liberty cannot coexist for very long.

I don't believe the Constitution mentioned any drugs or mild altering substances. But there is one amendment to the Constitution that does: the 10th Amendment. It states that powers NOT GIVEN to federal govt. is reserved for the states AND THE PEOPLE. So something like the right to consume oranges or liquor or.....anything that is not specifically stated in the Constitution is reserved for the States AND THE PEOPLE to do as they see fit.
The Constitution make no laws that governs what comes out of my body as well as what goes in (except for the freedom of speech to its credit). It is from the individual free thinking people that wonderful creations and ideas emanates, never from government bureaucrats.
The founding fathers are failing. It is up to us, freedom loving and free thinking individuals, to restore the balance between the government and the people that our ancestors so carefully crafted in the Constitution. How do you know when that balance is restored? When the govt. FEARS THE PEOPLE instead of people fearing the govt. which is what we have now! Enuff ranting for now.

the war on drugs, a civil war, a war against the countries own people.

oh sure, very constitutional and moral.

specially since its mostly a discrimination against taste and preferences.and an attack against liberty.

about as ridiculous as someone walking down the street with a chocolate bar and everyone going ," hey he´s got sugar! healthhazard, lets kill him!"

(life in prison is in many ways a deathsentence)
