In Cali, if I'm a Federal worker, should I get a card?

Hello,

I'll be moving to California next week and I'm a Federal worker. The position does NOT require drug testing. But, I'm concerned that if I want to grow my own and i get a medical card, could federal LEO's search the state card database and see that i'm in there?

My concern is that since i'm supposed to keep all federal laws, i could lose my job by growing in accordance with state law because its against federal law. Is this concern valid or am i just thinking too much about it? I just dont want to lose my job.

Just don't get the state card if you're worried. The state card is only really necessary if you want to work in a dispensary, or if you'd like to license a collective. If you're interested in strictly personal use and cultivation there is absolutely no need. Something like only 1 in 14 mmj patients in California actually have the state card.

A doctor's recommendation is all you need, and the information a doctor has about you is confidential. The federal government has no more right to know what medications you use than it has a right to know if your female co-workers take birth control.

That's great news! So, let me run an improbable scenario by you. Let's say I get a letter from my doctor (i've got so many medical problems so this wont be an issue). I grow 6 plants in my house. LEO's come busting in for some random reason, but if I have a letter from my doctor and i'm in compliance with state law, then i can't be arrested. Is this correct? Please pardon my paranoia...in the state i'm in now, LEO confiscates your house for only 1 plant.

Thats the way its supposed to work, and generally does as long as its a personal grow. This assumes you don't somehow attract the attention of federal leo in which case your letter will mean nothing. I don't believe California will sieze property either over a small grow even with a non-medical grow.

Cool - yeah, i hear that you can have up to 6 plants, so that's the plan. Even though i havent moved there yet, it is such a relief that i'll finally be able to grow my own without fear, without having to wonder what kind of crazy insecticides have been sprayed on my buds, and without having to meet some dude in a parking lot at night to buy it. It' s almost nirvana :)

Just to cover all my bases: lets say my 6 plants produce more than i need. Would i be able to sell my extra to a dispensary without having to get a card?

The actual truth is 215 does not necessarily keep you from arrest... but it does give you a defense in court.

its gotta be pretty dam good and cheap and alot of it for them to even consider it most of the time

Most dispensaries will not buy from you without a doctor's recommendation, unless you know their buyer personally. The card is not necessary.
If you work for the federal government you may still lose your job if you are busted by LEO. A couple scenarios:
1. You're busted by local LEO (state, county, city) in CA and you're acquitted. If your federal agency finds out about this somehow you could lose your job and have no legal recourse because you are still in violation of federal law. I'm guessing you have low or no security clearance, so this is highly unlikely.
2. You really mess up and some kind of federal LEO busts you. The odds are that you will lose your job, even though you were busted in a medical state with the appropriate paperwork.
Life isn't fair when you work for an evil empire. Ask a storm-trooper.

I would personally advise against this, especially given the economy right now.

You work for the federal government, and in the eyes of the federal government, pot is illegal everywhere, regardless of what happens on the state level.

I would get your card (not the state one, just one from a regular doc) and just get your medicine from a dispensary. This way nothing will ever happen.

If you decided to grow, and were busted, your employer will find out, and you will be fired.

There is no reason to risk it. Your questions about "extra" indicates to me that you want to make some extra money on the side. Not worth it unless your ok with losing your federal job.

Wierd, whenever I went to a club as a vendor they never checked for any paperwork. Just wanted to see the product and hear a price. Maybe 1/10 asked to see doc's rec.
