Growing within a business building with guns at home?

Say somebody were growing somewhere inside a multiple story business building that this person owns, and in highly unlikely scenario where the grow is busted... and the person has guns, at his place of residence(NOT AT THE GROW LOCATION), would he get in trouble for those guns?


Everyone knows guns and growing don't mix, a big no no in the law. If somebody has numerous guns in their name that they own, but they get busted for growing, will they get in trouble for those guns even if the guns are nowhere near the location that the grow took place in?

Say the guns where at a house miles away. I understand the law to be "Possession of a firearm during the commission of a felony."

Though could you get in trouble for the guns if they are not actually near the grow op? Would them finding the grow in the business building - which is unlikely in the first place, lead them to get a warrant for your home residence? And would guns there effect your charges even though they're not with the grow?

tricky situation.

non med state + grow + guns = you're fucked. keep them as far away as possible. in a non med state you should be growing at a seperate location, and keep paperwork related to your clean spot (where the guns are) seperate so cops cant hit both.


med state, california for example, is a little different. if the guns are legally registered there is usually no problem. if the guns are illegal = big problem.

i have prop215 paperwork and own several legal firearms. i keep them both seperate by 30 miles and different counties/cities/jurisdictions. guns in the grow is a bad problem and you are gonna need a good lawyer...

my other guns im burying in the hillside and not digging up untill the revolution..
 
Yes, probably.

Police are as clueless as everyone else. When they bust someone for growing and then search the home and find guns they automatically assume "drug dealer."

I think the ACLU or maybe the SAF have pursued some cases recently regarding medical marijuana growers and the loss of gun rights.

also depends on laws in your state..

in california there is legal writing along the lines of...."in order to be charged with possession of a firearm in commission of a felony, the firearm must be within reasonable access during arrest" or something like that...not sure what it exactly says. there was a big debate about this on CalGuns which is a gun owner forum...

but yeah...keep that gun as far away from any illegal shit as possible. if its in a totally seperate house 30 miles away from your grow its hard for them to combine the charges...they will still seize and take your guns, and probably revoke your right to own arms, but at least you wont be facing firearm enhancements on a felony which is MMS 2-3 years (cali)

Around here.. Yes.. if they want to.

I know a gentlemen doing 5 years over a commerical grow in an industrial setting. Both home and op were raided.. Guns (norman shotguns, etc) kept in the clean house were taken into account during sentences...mandatory minimums applied.

I know another gentleman sentenced light (house arrest/probation) despite being nearly 300 plants and having older hunting rifles. Feds didnt take the case... although this was nothing to the scale of the other. Guns never even brought up.


Basically they'll likely charge you with everything and anything.... It'll fall on your lawyer and wallet to determine what sticks and your consequences.

But rest assured your home residence is likely to be raided as well at the same time as your OP provided your bust wasnt just some fluke X factor type of downfall. If any investigation led to the bust they are coming in everywhere.
