Grower's Certificate in CA?

Bear in mind that growing in CA with a rec is still federally illegal. If you ultimately do grow 99 plants and get busted (let's hope you don't...), life will get a helluva lot worse than getting busted with oh lets say 10 plants.

And if I had "room to grow" (so to speak) in CA, I would go for the higher quantity medical recommendation if I could.

(Alas, I am newly arrived in CA from the Reich-wing coast (VA), and the best regions to go "green" (Sonora | Mendocino | Humboldt | Trinity counties) are way too bloody expensive, especially without a J.O.B. lined up. So I am in a "holding pattern" over Sacremento, burning cash.)

Depends what you have available to you. If you have 14 friends that would let you use their script, it will look much better legally then one single script for 99 plants. In court it will be much easier to say "I grow for 14 different people" vs "well the doctor said I could grow 99 plants so I did"

No. Federal kicks in at 100 plants so 99 is the magic number in California to be safe.

Thanks for the responses. Not really planning on doing that large a grow... it's more one of those things where if it's good to have I'll spend the extra $200 just to have it. If it's a worthless ploy the doctor's office uses to make more money then I'll pass. Just wondering if it actually carries any weight whatsoever with local law enforcement or in a county courtrooom (hoping to avoid both obviously). Thanks again!

I don't have any links to it... I'm up here in Sac though and a lot of the doctor's offer it. I guess they cap it at 99 to stay below the federal limit. I actually briefly talked to a defense attorney about it today and he said he would get it if he were me... although he's not sure how it'd turn out in court. I didn't get any further than that though.

They are offered in SoCal as well but by much fewer docs. The ones that do it usually charge significantly more for the 99 rec, some just don't care and charge the same. It's in the eye of law that you want to pay attention to.

It would be much better looking legally if you had 10+ different scripts then 1 script from a judge/jury view. Hard to say that you needed to grow 99 plants just for yourself.

it all comes down to what you medical ailment is... If the doctor feels you have a legit enough condition, that they are confident in appearing in court for you stating that they recommended the proper amount of medication for your illness. They don't always recommend 99 either, it all comes down to the adequate amount based on you're medical condition

It's just that. The Kelly decision did away with limits, so if you want to grow 99 plants with just one rec, go for it. If your local DA decides to come after you, I highly doubt a fancier recommendation is going to help your case.

Others have made good points about more recs looking much more legitimate. Consider that seriously. Write up a simple collective agreement and have everyone sign and date it. Something along the lines of: “As qualified medical marijuana patients under California law, we choose to associate collectively and cooperatively to cultivate marijuana for medical purposes. All members of our medical marijuana collective will contribute labor, funds, or materials, and all will receive medicine.” The discussions I've had with several attorney friends have led me to believe this is the safest way to go.

if you wanna go over 100 get more scripts....simple as that. i know some scripts that are being used in multiple grows...no one checks just counts..

Your physician will ask you how much bud you consume on a daily or weekly basis and make his recommendation based on that figure. A friend of mines got a 99 plant rec for chronic knee pain, he really does smoke close to a half ounce a day for the pain.

On a side note; Plant numbers are such a retarded way to regulate quantity. I flower over a hundred clones under only 1800watts risking massive jail time. Mean while, someone with the same rec, but who has a backyard or more grow space can pull huge weight from smaller plant numbers while keeping it legal.

i wouldnt ever go over 99... No matter how many recs you have.
A good friend of mine got busted. The DA flat out told him if he didnt have over 99 plants then they wouldnt have charged him...

yea i know people up north right on the limit. running 99 smartpots 100-200 gal a peice. pull 3 lbs from each and they are pulling quater million dollar harvests.

yet a kid running a 5k in his bedroom can easily go over 100 if hes using smaller pots and running SCROG.

im at around 130 right now...my freaking veg chamber/clone chamber puts me over the limit, but my brother and cousin getting their script soon so il be good.

There is no place in 215 or 420 that mentions "Super Recs"!!
Kelly Decision took care of the plant number thing...and now you have to prove what you are growing is consistent with your needs--
Good luck with 99 plants under 1 Rec...unless it was all 5 inch plants--
All you need is several ppl's Recs, like stated several times above--
As far as the 99 plant thing and the Feds...unless you are taunting them, they will not even notice you--
We had one of our places rolled by local Po-Po, with over 700 plants outdoors (Greenhouse)...and it got dismissed...no Feds involved--
Another friend got Probation for almost 800 in an indoor warehouse with no Recs on site!! (Yeah stupid move...I know that--)
DEA does not have the resources to go after everybody--:tiphat:
