Friend just busted for furnishing marijuana to a minor in Cali..what to expect?

just learned a close friend got caught smoking in a car with someone under 18. he has no prior criminal record, but doesnt have legit 215 paperwork. he ended up spending the night in jail which is absolutely crazy for a marijuana charge here in california...i believe they are charging with 11361 furnishing to a minor but not sure yet...definately not a possession charge because he did a night in jail...

i looked online and the penalty is saying 3-7 years in prison! holy shit! is it really that serious?

kinda worried about my friend..he definately aint the kind of person who could survive jail time.


has anyone been caught or charged with something similar? trying to relay advice to him...already told him to find a good lawyer.

also the minor is an aquaintance..is there any way we can have the minor testify it was his weed and he knowingly smoked it without my friend? we can definately make the kid say whatever we need him to say in court.....im just hoping youngster didnt fuck up during the arrest and admit to my friend selling him the dope...then we are fucked. im still trying to learn the details and il update as i find out more....gotta get my friends back because hes a good dude definately doesnt deserve this...

If it was just the kid smoking I would say his chances are better ASSUMING the kid hasn't said anything.

If so then ya get a good lawyer and the argument will basically be "look the kid had his own bud, he smoked it, I was just driving"

If the kid copped to your buddy selling him weed then you still need a lawyer, but much less optimistic. Courts HATE shit like that, regardless of the state. It is very good that he has no record, I would honestly say he still has a chance at just getting probation.

Biggest thing is dont let him trip out, find out the info first and get the fucking lawyer

not sure of the details yet...but as far as i know..both were caught smoking in the car, both had marijuana on them. the purple he had matched the purple the kid had...the kid is the younger brother of another close friend, so we have influence over the kid, but i dont know what was said in person...meeting up with him this weekend to go over the details and hopefully forward him some ICmag advice..... overall this situation doesnt affect me at all except that my friend knows an oldtimer outdoor grower that had super cheap prices during the harvest season last year... these are old friends a few counties away. but i wanna make sure he doesnt get a bad deal because its his first time through the system....ive told him forever to get his 215 paperwork in order, but that would not have saved him from the "furnishing a minor" charge..

Damn Bro. Sucks to hear. Tell your boy to get a lawyer as the weed isn't a big deal, but the fact that a minor was involved is. Like was said earlier, the courts dint look lighttly upon this sort of stuff. I know a great criminal defense lawyer if he needs to talk to someone. I'm talking about a lawyer that runs a huge firm here in SF occupying the 40 th story in one of the nicest high-rises downtown. He's a national criminal defense lawyer and used to teach as well. He's not only a badass but he's very fair, very attentive and will always get back to you and answer your phone calls. These are traits I've never dealt with when dealing with typical criminal defense attorneys. Lemme know and I'll put in a phone call for you.

Biggest thing when you meet with the kid and your friend is to make sure they are honest. Especially with the kid, tell him ur not gonna flip either way, you just need to know EVERYTHING he said to the cops during and after the bust.

Either way, your friend needs a lawyer. If the kid never admitted that your friend sold him the bud (aka they were just smoking together) and it was never stated WHOSE bud it was, then hes in a good position. You have the kid say the bud was his, he shared it with your friend, end of story.

If it did come out that your friend sold to the kid then you just gotta hope his clean record and good lawyer can make it go away. Get the kid to say the cops were intimidating him and he agreed that your friend sold it to him because he was scared bla bla.

There are still lots of possibilities, we just need more details

cali dont like to give jail time for first offenders , they would rather you on probation and drug classes both which you pay for . i doubt highly he will get any jail time. they just want you in the system
