my employer told me i cannot take leave for when my baby is born. so im going to call in sick for a week and then its a 99% chance she will try to fire me after that. so i gotta get prepared.

By law they have to give you leave...

Just to make sure I got this correct, you arent the one pregnant, otherwise you would probably know your states maternity leave laws. And no there arent any employers I know that give men maternity leave.

Secondly if you call in sick for a week after they have it on record that you asked for that time off then they have every reason to fire you justifyably, that also means you wont be eligible for any unemployment benefits.

With a baby due maybe you should focus on keeping that job cause even if you do get unemployment its only going to be a fraction of what you were making when you were working.

ok verite. i'll just let my mom and sister be stuck at the airport 2 hours away and have my wife fly to the hospital 3 hours away and never see my babys birth. ya, good plan. my wife is the main bread winner i dont earn most of the income. family first man, family first.

and another associate at my work got 1 month baby leave and he was hired as the same position as me. and he doesnt qualify for it either. and he got it.

How many people where you work? Over 50? Then by law they have to. It's called the FMLA - Family Medical Leave Act ( http://www.dol.gov/esa/whd/fmla/ ). If it's under 50, well then they're just being pricks about it and I agree with you - screw 'em. Wife's more important than work.
Unless you truly are needed right now by your employer. Then I would try to negotiate with them to work something out. It's one thing to burn a bad bridge. It's entirely another to burn a bridge badly.

there are over 500 associates. I work in the garden center and its too cold any rainy for anyone to be need there this time of year.

ive tried to talk to my boss on 3 different occasions. the first 2 times she simply said she didnt want to talk about it. the 3rd time she raised her voice and said theres a slim to none chance i will qualify for family medical leave. and i gave her a couple of days between the times i asked her so it wasnt like i was being pushy at all. I was actually being very polite about it.
