Hi everyone,
Since I keep encountering partially wrong information regarding the laws surrounding Cannabis in Germany, I wanted to give an overview here from a growers POV who has had the "pleasure" of growing legal weed for full 6 months now.
I start with homegrowing, go briefly over traffic related issues and then will go on to the topic of social clubs finally following medical cannabis and closing with some final words. Basically covering all you need to know.
HOMEGROWING:
Lets start with the most important wrong fact:
It is NOT a legalization. Sharing a joint is forbidden!
It is a decriminalization and not a very good one at that.
Why? Because smokers and growers still get persecuted, even though the law clearly should prohibit such infringements on privacy now.
Another reason why it is not a good concept, are the numbers.
Allowed are max 3 plants at home, size doesn't matter.
Allowed is max 50g of dry flower/hash/rosin at home & max 25g of dry flower/hash/rosin while outside(those 25 count towards the 50).
In between 50-59.9 at home and 25-29.9 outside you WILL get fined a ridiculously high amount.
If you are over 60g at home or 30g outside you might go to jail.
There are no clear terms on what is a seedling, what is a cut, on what is what in too many areas.
It is impossible to keep mothers, breed, phenohunt or do anything that isn't just straight up cultivating bonsais.
While you're allowed to buy up to 50g per month in clubs once they roll out, there is no way you can have 50g per month as a homegrower without farming the whole year(at least when keeping it legal).
Quite discriminating against people who can't afford it or simply are a true homegrower, but that last sentence is just my humble opinion. Can you smell the GreenRush already?
TRAFFIC ISSUES:
Drivers licenses get popped left and right here.
Germany and Austria are the only 2 countries worldwide having a really abusive system in place called MPU(medical psychological examination). This means basically, if you're a smoker, you can't drive.
Data and facts from Canada for example got ignored, so we got a limit of 3,5 nanogram now, which is an improvement to before, but still terrible, because a limit of up to 10-12 nanogram shouldn't be problematic according to science.
Also other countries already showed how it works.
SOCIAL CLUBS:
Not much to tell here yet except that it's an overcomplicated system that's doomed to fail in my eyes.
Not many permits have been approved yet.
Curious where this goes, especially price wise for the consumer.
There are a few real ones out there, but a lot is just GreenRush.
They are also not allowed to advertise in any kind, which makes it kinda hard for them to do prevention work(which is mandated by law), don't you think?
MEDICAL:
Medical Cannabis is complicated.
Some people get it for free, some have to buy it, some don't get it at all and need to get private prescriptions, because they want you to get addicted to opiods first, before you can become a cannabis patient.
At least it's available with private prescriptions now.
But the prices for good quality are high and people who need medicine often can't afford those.
The cheap ones are sub par for medical standards.
I'm in shock about what type of boof is partially presented as medicine.
Shameful. It's pure greed that is leading the way in those cases.
Guess that what comes if a medical market opens up & you have a bunch of uneducated patients/consumers on top.
FINAL WORDS:
I'm not complaining, but also I haven't written out every detail of idiocracy within the German Cannabis Law.
It's a good first step, but there is the risk that next year a conservative party will get to rule again and that they make it illegal again.
Personally I hope there is no way back, but after Covid nothing can surprise me anymore.
If you grow fire & got funds to build a facility, Germany might be the place, because I don't think that medical is getting rewinded, no matter who wins. Money talks.
Like it looks this is the only way for now to legally distribute Cannabis in Germany, because the model projects around the Säule 2 (2nd Pillar. 1st Pillar is Homegrowing "legalization") are not going to happen most likely, which means there won't be any dispensaries outside the medical sector, if nothing major happens.
