Long story short: My brother and I were caught in possession of 500 grams about 6 months ago. Of course we are now being sent tax notices by the IRS which include the tax/gram and a fine for failure to pay before getting caught. We have also been charged with conspiring with each other to possess/sell so the authorities have acknowledged that it was a cooperative enterprise and not two separate ones.
My issue is: we are both being assessed tax on the 500 grams, they want us both to pay tax as if we each had 500 grams, as opposed to 500 grams between the two of us. In my book that's double taxation. Is there any way to fight this?
