Double Taxation?

Long story short: My brother and I were caught in possession of 500 grams about 6 months ago. Of course we are now being sent tax notices by the IRS which include the tax/gram and a fine for failure to pay before getting caught. We have also been charged with conspiring with each other to possess/sell so the authorities have acknowledged that it was a cooperative enterprise and not two separate ones.

My issue is: we are both being assessed tax on the 500 grams, they want us both to pay tax as if we each had 500 grams, as opposed to 500 grams between the two of us. In my book that's double taxation. Is there any way to fight this?

What do you mean tax??? I don't understand what your saying here. The IRS wants to tax your weed?? I've never actually heard of that happening in a tax state.. How much are they trying to make you pay??

$3.50 a gram (500 Grams) + $750 for failing to pay tax before getting in trouble. I believe it's the state that is imposing this tax (North Carolina) but it could be the IRS.

I have no experience with southern laws... But I honestly can say I never heard of aybody having to pay tax.. So you got charged $750 for not getting your tax stamp?? How does somebody go about possessing a tax stamp?? I just don't understand that. So you have to apply for a tax stamp before you possess an illegal drug?? Then after you get the stamp your drugs are still illegal?? Why would anybody ever pay that?? Anbody else have been caught with possession in a Tax Stamp State?? What exactly are you charged with and how does somebody apply for a tax stamp??? Also do they actually issue these?????

The federal government did. That's how marijuana was first made illegal, as you said. But tax stamps were declared unconstitutional in the mid 60s. That's because you could, in theory, only get the stamp if you were in possession of marijuana, which was illegal to possess without the stamp. So you had to incriminate yourself to be in compliance with the law, and that's not allowed. That's why we have the Controlled Substances Act.

I believe I read somewhere (probably here) that some states still do have marijuana tax stamps. Seems hard to justify such a law at the state level when the federal law was invalidated. But such is our legal system.

taxation and regulation of cannibis by inforcing the states cannibis tax stamp laws.

now ifn this be the case is the states Tax stamps gonna be available to the state to dispense to the ppl

very interesting indeed ive read about alot of busts seen them on news and your is the 1st i've herd they went after for back taxes and penilties for not obtaining the stamp.

I would assume that when you and your brother were busted that you were both also charged with an offense(s)? If so, have you hired an attorney to help with your defense??
Bring your IRS documents to your lawyer, they'll know what needs to be done.

you are so right, such is our legal system, states can make laws to have tax stamps even though its unconstitutional federally, but states can't trump mmj? grrr

Attorneys have sent appeal letters that have finally been returned with notices saying we have 30 days to pay or face an additional 20% fine (now 6 days) and that our cases are no longer subject to any further appeal. The fines were assessed initially in november/december and thus nothing to do with obama.

Probably going to have to pay it although my lawyers office said to contact them and try to get it reduced due to inability to pay (I'm a student with literally no income.)
