Different States Lenient Cultivation Laws

I was browsing around on the NORML website at different states laws concerning cannabis cultivation. I was totally caught off guard by how lenient some of the states laws truly are.

In Illinois, cultivation of up to 50 plants for first offenders is only a misdemeanor and 2 years probation and the charges are dismissed at the end of probation, so in the end you record is clean.

Maine has it even better, cultivation of up to 100 plants is a class D misdemeanor with up to 1 year in jail and $2k fine. Aeroguerilla is always posting bust stories where people are caught with more than 100 plants and it seems like they get a slap on the wrist.

Wyoming, get this, this place is the best, cultivation of any amount is a misdemeanor with no more than 6 months in jail. Did you hear that, CULTIVATION OF ANY AMOUNT.

I'm not going to list every state, but I was just amazed with Wyoming, I mean, any amount is a misdemeanor, I don't think I've ever heard a word about Wyoming on this site and it seems to have the most lenient cultivation laws on the books, apart from mmj in other states.

I knew about some of those but wow @ Wyoming. I wonder if the feds pay any special attention to that state.

Fed don't care they can and will take over any case they see fit to do so and they will win be careful just looking at the state laws...

I really wish that the situation in Maine was more clear. I have heard so many different stories about was is, what will be. I know they are having some big public hearing this spring and most people are very concerned about how it will play out. Anyone who knows, or thinks they know, I would love to hear what you think.

Just looked at the possession laws in Wyoming and yeah, they are very bad, I can only assume if they find a grow you will get possession charges even if there is no dried product.

Alabama has a mandatory minimum sentence of 3 years in prison for 1 seedling...

If I get raided, I'm guaranteed to be a media posterchild... ugh!

I used to live there, and believe me it sounds good but WY cops are serious assholes. It sounds enticing, but they are not so lenient in that part of the country.

Any ammount is a slippery slope, does one plant qualify you for 6 months in jail?.. Around there, I wouldn't doubt it.

NORML is useful for a state overview, but for more complete state information including intent and conspiracy laws, it's better to look directly at that state's posted laws, and read some prior cases in that state.

These poor folks were arrested and charged with about 100 plants in Wyoming a couple months ago. They also had a good bit of cash at their site; the state tacked on intent and conspiracy charges as well. Intent and conspiracy laws are not spelled out on NORML, but I reckon all states have them, along with the feds of course. Here is what the article had to say about the WY charges ...

charged with possessing more than 3 ounces of marijuana, possession with intent to deliver and conspiracy. They each could serve more than 20 years in prison if convicted.
NORML does a pretty good job of reporting basic state penalties, but the devil is in the details.

For a non-MMJ small personal use grower, Alaska and Maine both look pretty good to me. Probably very low risk of getting reamed over a few small plants in Maine; the same situation in AK shouldn't be a problem, as long as your op is safe and you stay cool. CA I feel confident would not bother you for a micro grow, unless your were in a hostile redneck area. Arrest charges for such minor deals often go to simple possession in other states as well, especially if there are no extra charges or priors. Just don't let it go to trial, if at all possible.

Keep grows small and stealth, with odor control both completely effective and redundant. Run a backup odor killer constantly. i.e a secondary odor eliminator working. Never grow any of these smelly bitches because they might overpower your scrubbers. Always live by rule #1. Oh, and read the Grow Security Thread in my sig; it's worth a look.:bump:

Yeah and, you know, we all love to smoke rootballs. I've found good canadian peat burns best but I like it to have a few grows in it before I smoke it and sell it off. he he he...

Alaska, I've been told by NORML, is probably the safest place to grow weed for personal use. Look into their state constitution - it's very friendly and has been upheld by the state's supreme court. I've read that the cops basically have a "under 100 plants and you didn't see anything" unspoken rule. Now if I could just get my wife to live in the sticks.

Yeah, I've spoken with GrowerGoneWild about Alaska laws, he lives there and says anything under 25 plants is within your right to privacy. Whats funny is their medical program allows you less than that.

Alaska has good laws regarding cannabis, I think it is a much different place when compared to the lower 48, climate and people wise.

Illinois, thankfully, seems really leniant.........5 plants or under is a Misdemeanor..anyone know of any "fine print" in Illinois pot laws?

uh, I heard personal use in chicago was nearly legal, the cops could care less.

Yeah, Illinois is a good state to be a grower in. : )
