Florida Cop Dresses as Electric Company Worker to Snoop For Pot Without Warrant

​Florida cops, it seems, will do just about anything to find that marijuana plant growing in your closet. The U.S. Supreme Court will soon decide whether Miami police violated the Constitution by routinely sniffing around suspected grow houses with drug-smelling dogs without first getting a search warrant.

In Tampa, meanwhile, police are dealing with backlash this morning after admitting in court they used a list of questionable tactics in pot busts, including dressing up as electric company workers to get into houses and spying on customers at a hydroponics shop using a hidden camera -- all without warrants.

The revelations came during a hearing with an attorney representing a number of people arrested on marijuana charges in Pinellas County.

A detective named Paul Giovannoni admitted that he'd approached one man's house wearing a Progress Energy shirt and let a homeowner take him around into the house's backyard believing he was there to check the meters.

Giovannoni had no warrant or probable cause to search the house, he admitted, but said "it was just a ruse ... to see if I smelled marijuana."

The Pinellas Sheriffs recently suspended another detective after the Tampa Bay Times revealed the force had secretly placed a video camera outside a hydroponics shop in Largo, Florida, and used the footage to track the store's customers.

The county's sheriff, Bob Gualtieri, tells the Times he's "appalled" by such tactics and promised to institute a new rule that cops can't wear other companies uniforms to get into houses without a warrant.

What, exactly, does it say about Florida cops' knowledge of basic civil liberties if you need to make it clear that posing as an electric man to test your hunch that a house has pot inside is a no-no?

"That's obviously an illegal tactic to pretend that you work for Progress Energy to get on someone's property," Bruce Jacob, a Stetson University law professor, tells the Times.

In another civil rights-bending pot case, the U.S. Supreme Court agreed on Jan. 7 to review a Miami case called Florida v. Jardines.

A Miami-Dade police team in 2006 used a drug-sniffing dog at a house belonging to Joelis Jardines. The cops only "evidence" that Jardines' place was a grow house was that his air conditioner was running non-stop.

Jardines was arrested after the dog smelled pot and police busted in. The Florida Supreme Court sided with Jardines that police should have gotten a warrant before letting their dog loose on his property; the Supremes haven't set a date yet to hear the case.

Yeah they do it all I hear .. I hear they come in as the cable guy , hydro ,elertric,telephone you name it they will try to find their way in.. The fact they can do nothing is sweet.. I would not want cops acting like this for cannabis it's so sad. headband 707

after living in florida and seeing and hearing all kinds of shit . nothing the cops do there suprises me. one of my main reasons for leaving. florida was one of the first to have counterfeit controlled substance law. i saw one dude get popped with a pack of goodys powder. i think its powdered aspirin? and get charged. the sentance is usually worse than havin actual drugs. hell no not me mutherfukkers. i got lots of other stories too

fuck those dirty tricks - but if they breech their protocol you can get that evidence gathered in an inappropriate way thrown out in court - this has happened to me twice....fuckin idiots !!!

I wonder how long it would take after setting up a big indoor tomato op and blowing that shit out till some 'utility' employee comes snooping.

any legal (financial) recourse or lawsuit that you might be able to spin if they raid a completely legit indoor tomato farm?

I know someone that got busted from the place in Largo from when I used to live there. The store was way out on Ulmerton rd not sure if it was the same one. The store moved after that still in Largo and then somewhere else.

Anybody else from FL will understand this right off, but the one time I went there the guy was all up on me hows things? Need any questions answered? Here's some grow information on new techniques and I was like no thanks and left without buying anything. It's just something that doesn't happen in FL even at Worms Way. I said to a friend of mine that I thought it was a front for the cops something just didn't feel right and then one of my grow friends gets busted and it originated from surveillance from there he found out.

I am so glad I left that Super-Police State :rasta:

i got harrassed alot in fl. cops asked me are you dumb we are gonna get ya . next day had new car and fl drivers liscense and left. i got the hint
 
Guy came once and said he's here to check the smoke alarms, so I let him in.
He asked me to turn the lights of at the fuse box but not the power switches.
Seemed a bit strange to me as no one else has asked me to turn off the lights at the fuse box, and to check the smoke alarms you would think he would need to see what he was doing.
I was thinking he wanted the light off but not the powerpoints so he could see if any bright lights were shining from under doors.
And this must be read in the context that I was under surveillance at that time and got a knock and talk also.

I like where your heads at :tiphat: your allowed to do that even if you get pulled over. When I lived in Utah you'd hear all the time about fucking crazy whiskey tango ppl "pulling" other people over claiming to be leo, you can fill in the rest

:nono: Agree. Sorry, but NOBODY comes in my house for ANYTHING unless I called them out first. But,,, I am a DIYer so, NOBODY comes in my house period, especially when there's a functional GRoom.

Around where I live the criminal element uses this same ruse to get in your house to rape and pillage. I am one rude dude when you come knocking on my door without an invitation. I also will come around from the backyard to answer the door. That scares the crap out of them. They always expect someone to answer the front door.

No, the smoke detectors work on batteries only.
And at the fuse box there is one switch for the lights, one for the power points and one for the fridge.
He wanted the light one switched off and the power ones left on.
He didn't want everything switched off as he would if he was checking that the smoke alarms worked on batteries if the power went out.
