CA might decide MJ equip is not drug paraphernalia?

I wonder if this would take away law enforcement's ability to enter a dwelling because of just seeing a bong... That would be great to take away the plain sight rule in regards to using our favorite plant.

Yesterday, members of the Assembly Committee on Public Safety voted 5-2 in favor of Assembly Bill 1811, which would amend the state's definition of 'drug paraphernalia' to exclude items associated with the use of medical marijuana.

California NORML testified in favor of the measure at yesterday's hearing. The proposal now goes to the Assembly floor for further action.

California's current blanket ban on so-called 'drug paraphernalia' is untenable given the legal status of medical marijuana under present law. It makes no sense to allow patients to possess and cultivate medical marijuana while criminalizing the means of using and/or producing it, including equipment for testing and analyzing marijuana potency and inhalation devices designed to reduce the hazards of marijuana smoking.

I believe there is language like this in the initiative to legalize. I know it was in the Tom Ammiano bill to legalize. One way or another this MUST happen.

If possession of cannabis paraphernalia is no longer illegal in CA, then it removes a major arrest incentive. A cop won't be able to say, "I saw a bong" then search and arrest someone based on that alone. It won't be sufficient grounds for a search anymore without other evidence that the person is breaking the law somehow.

I dont know about anybody elses experience in cali. Cops in my city could give an effe about a bong, pipe or anything else MJ related.

I have been pulled over by highway patrol with an oz and was told to grind it into the pavement.I proceeded to pretend and went back for my buds as soon as i could get back to them. I had to drive to the next ramp take the freeway back then get on the correct ramp and find the place i was pulled over.

Nowadays im not willing to carry more then an 1/8 but most likely just a few joints. I dropped a joint in my wifes car that i still haven't found. I bet my 17yo found it. little shit.

i used to work security for a rowdy off campus state college. kids would put bongs outside on their 2nd floor window sills and even tho in plain sight, the cops couldnt do anything because a bong by sight doesnt mean its used for cannabis. so they werent allowed to go in and ask to see it. i also think that they couldnt be held responsible anyways since it was technically outside their dwelling and property of the apt's.

Every 38 seconds is a scary stat indeed. So 11% were those that required an actual investigation to get them it looks like to me. Go Figure!

In my little corner of the world they arrest the kids for possession take them down town and give them a choice. The one's that have any kind of connection to anyone dealing is offered a debit card and freed. Once free they use this card to get money from any money mover and document who what where and why. Once they get 10 purchases they call a number give the info and the Police round them up.

Tax Dollars at it's finest. Be a snitch get paid and smoke for free.

America at it's finest.

yea the "regulate, control, and tax cannabis" aka taxcannabis2010 does. It says it amends the section of the health code relating to drug paraphernalia and later says "it is lawful and not a public offense to.. possess objects, items, tools, equipment, products and materials associated with activites permitted in this section".

It cool to see the legislature acting on this, but I thought that if you were a legal medical patient it was a given that the paraphernalia is legal too?? Never heard of a patient getting arrested for paraphernalia.. I guess it's just to take away the probable cause for a search just based on there being paraphernalia.. California's starting to look more and more like home (not like I wasn't planning on moving out there anyways, its a beautiful state with something for everybody!)
 
Yeah, they wouldn't know if you are a med user or not. If they saw paraphernalia, they could come into your home. You would have to tell them you are a legal med user.

..but ah... I guess not anymore!
