Busted, need to know my rights

Hello everyone,

First off I'd like to say I love ICmag...I've been reading this forum ever since OG shut down and it has provided an extreme wealth of knowledge...Thank you so much everyone for all of your contributions.

Anyhow, it seems I've gotten myself into a bit of a pickle, and hopefully you guys here can let me know whats up.

I live in a dorm at a state college. While I was out, not in my room, the RA came by and claimed to smell alcohol coming from my room, from under the door? I had an empty bottle of wine in my trash that is kind of near the door, but I corked it...

Anyhow, since I wasn't in there and they smelled alcohol, they knocked and no one answered. So, they got campus police to open the door and took all of the booze out of my fridge (lots of shit, beer, patron, whiskey, gin, vodka), and also my 16" ROOR rasta label with a headie slide....Also they took my candles and oil burner, as well as my very small ash tray with a little bit of ash in it.

So I come back to my room at 11:30 at night, and all of this shit is missing. No note from anybody, no notification at all. Shit is just gone from my room.

They did not take bud that I had under my bed, or my grinder which was on the desk. Supposedly they saw the bud under my bed, but could not take it because its not part of the school's property. That last sentence is word of mouth from a friend.

Here's the weird part: I haven't been notified at all about any of this by anyone official. Only my friends have told me what theyve seen/heard. No note was left, i havent been called, no campus emails. Just shit missing from my room. I can assume I've been robbed at this point, no?

If they do not inform me of what they have done within a certain time period, is this illegal? OR are they just waiting to figure out what to do/acquiring a search warrant right now/testing my ROOR for resin? I just cleaned it the other day, so it had a little bit of resin but not much.

I just want to know my rights and what I should do about this situation. I haven't talked to anyone yet, I should maybe talk to my RA or campus police, or wait it out?

Maybe I should note that I do live in a state in which possession of under an ounce is decriminalized.

I know I do go to a state school though, so that isn't good.

edit: I know from multiple witnesses that campus police DID go into my room. I really, really, really doubt I was jacked, my door was locked when I came back...Locked when I left. Multiple reliable witnesses told me they saw campus police in my room.

Your fine. If they were gonna do anythng it woulda happened by now. But go find a lawyer anyway. Just tell him the situation and get the free consoltation and ask his price. Take a card with you and then just live life as usual. No more drinkin or smoking in your room!! trust me on this one. They may just be waiting to see if they can catch you doing something else. And if they do the might just have a charge on you and just be ready to use it whenever. If they do arrest you they will try and ask you to make a statement. DO NOT MAKE A STATEMENT! No matter what. Just give them your name thats all then just ask to call your lawyer. As soon as some-1 asks for their lawyer the questioning must stop. Ask what your being arrested for and thats all. Don't say anytihng back at all. Don't admit guilt and dont deny it or give any story AT ALL. Just ask what your being arrested for, give them your name, and ask to speak to your lawyer. But the most they got on you is a paraphenalia charge. If they seen the bud they definetly would have taken it no matter what. They can't charge you with possesion if theres no evidence of it. Just stay cool i think your fone. At worst you have a paraphenalia charge, and whatever the campus rules are for alcohol, But thats not crimminal. Good luck..

Man that sucks! Been there....
Act like it is no big deal and don't make the same mistake twice. Time to ditch all said friends and start over, or keep them at arms length. Really, how many of those people are you going to stay in contact with after you graduate...maybe one or two. Been in your shoes and it sucks, but I learned my lesson too. I was always the generous one buying kegs and always providing the booze. Invest in a flask that will fit in your thigh pocket or inside jacket pocket, way cool, and a small safe to hide. That is what I did for the most part, but I am a girl so I had this cool purse thing that held my flask. Don't stash that much booze in your room at one time....just asking for trouble. Just buy as you go. I enjoyed going to the store and checking out what was on sale or learning about something new. I also found a signature drink and stuck with that. I then progressed into dropping the booze all together, for the most part, and just stuck with the herb. It helped me study longer and I really got into my subjects. So, I feel for ya and hope you find out who your real friends are.....stick with the herb and you can't go wrong! Cheers!

If they haven't said anything, I wouldn't say anything either. In the meantime, take the dope and any related drug items out of your room and stash it somewhere else or get rid of it ASAP.

I doubt the Campus Police took your legal to buy liquor and left your decriminalized illegal weed ... The bed might not be owned by the State but the Dorm Room it sits in is ... Someone is telling you stories. If your education was as important as the party seems to be the lost Liquor wouldn't matter so much ... that Patron is pricey stuff ... Did you buy that with Grant or Student Loan Money? Wait ... are you even 21 and allowed to buy/possess the alcohol Off Campus? I'm guessing Not ...

I definitely got everything out of the room - but I still have an odd feeling about all this. Why haven't I been notified? Is there a legal obligation for them to notify about this?

edit: the dorm room is actually NOT owned by the school, as I am technically renting it from them, so they don't have permission to search the entire room. I'm not positive, but I believe the furniture remains school property, so that can be searched without my permission? This is where it gets fishy.

I am 21 years old, and I bought everything with my own money, actually. I work pretty hard at full-time job and as a student full-time.

Sounds like a certain school i know of haha. Large 420 celebration? anyways you are probably best just to wait it out, nothing bad ever happened from that. If they are going to bust you, then its going to happen, no sense in seeking out trouble. If you ask someone about it, and they werent going to bust you originally, you essentially just turned yourself in, just wait it out would be my advice

They should notify you soon enough. but like i said they may just be waiting to see if you do anything else b/c they already got you for the alcohol and the bong. DO NOT go asking the campus. Your ppl could be playing a prank or you might of gotten robbed. Nobody saw any drugs. If so they would have been taken, period! You can't be charged with possesion without evidence. just go about your normal day. No more smoking or drinking at school. If you still feel worried go get a free consultation from a lawyer and take his card. if you have anymore questions feel free to ask.

Depending on what your campus security is like they may have just took your shit for themselves. I've seen and heard it happen before. Hell i even know people who have done it(not proudly admitting that. Just stating it does happen.) As for RA's the ones I've seen are mostly students themselves(seniors). So whats to say that they didn't take it knowing what you were doing was illegal on campus and that if you said anything they'd just call the cops. Not trying to bring you down at all man, just saying this may be a possibility you haven't thought of. Hope all works out.

Alright, so after thinking about it, they couldn't have seen the weed. They are cops, if they see weed they have to take it.

I think I will be notified by mail about this, but I still feel violated. I haven't been notified about this at all, and its been almost 48 hours. All I've heard is word of mouth from friends/witnesses. I'm absolutely positive that it happened though because of the multiple witnesses. Yet I haven't been notified that they were going through my shit. Is this legal? anyone have an idea?

Yes it's legal. Your are a tennent of theirs. Also when you sighned their lease i bet you also sighned something else that states you must be in compliance of all campus rules or you will be evicted... Just relax even if they don't notify you, so what? You haven't been charged with a crime. And you also haven't been thrown off campus... You should count your lucky stars and quit worrying about them notifing you.. Would you feel better if they notified you and said b/c of the alcohol they seized from your room you are now getting kicked out of school? HAHA i don't think so. Breath easy cuz, Let sleeping dogs lie. I'm pretty sure your fine. And i don't think you should make a big deal out of them searching through your stuff. Or else they might make a big deal of the liquor they took from you.. You feel me? If it bothers you that much tho that they went into your room, change the doorknob and get a new lock and key.. Hope everything work out for you.
