In two separate trials, one beginning this week and one beginning next week, British authorities are prosecuting medical marijuana providers under the country's drug laws, the Guardian reported. The continued prosecution of medical marijuana providers comes despite the government's downgrading of marijuana from a Class B drug to the less serious Class C in 2004.

Four members of Therapeutic Help from Cannabis for Multiple Sclerosis (THCforMS( faced charges of conspiracy to distribute marijuana this week in crown court in Carlisle. THCforMS supplies free cannabis exclusively to MS sufferers and says on its web site it has handed out 33,000 cannabis chocolate bars to patients.

Next week, Bud Buddies founder Jeffrey Ditchfield goes on trial in Mold crown court on nine counts of cultivation and distribution of cannabis. Bud Buddies offers a number of marijuana preparations for anyone with a proven medical need and requires documentation of that need from a physician.

Under current British marijuana law, all of the defendants mentioned face up to 14 years in prison.

Meanwhile, life has become more difficult for as many as 30% of British MS sufferers who use the herb to alleviate the pain and spasms associated with the disease. One of those patients, who asked not to be identified, said she had applied to use the marijuana tincture Sativex on a trial basis, but was turned down. The preparation is currently undergoing a three-year trial. "I find it inconceivable that the crown sees these prosecutions as in the public interest when there is still no legal way for the people who are helped by cannabis to obtain and use it," she said.

The British Medical Association said in a 1997 report: "While research is under way the police, the courts and prosecuting authorities should be aware of the medicinal reasons for the unlawful use of cannabis by those suffering from certain medical conditions for whom other drugs have proved ineffective."

Even if the crown prosecutors don't get it, some trial courts do -- or at least they did. Up until last year, medical marijuana patients and providers successfully raised the "necessity" defense, which allows illegal acts to prevent a greater harm. But an appeals court ruling last year held that the "necessity" defense did apply to the use of marijuana to relieve chronic pain.

there used to be this belief that when the children of the 60s grew up some of them would enter the governments of this world and help end prohibition...

it boggles the mind as to just who is holding back the Cause, surely it's a minority of rich people associated with the pharmaceutical & alcohol industries...and perhaps the various anti-drug agencies and prison industries...

i don't know...but 3 cheers for the compassionate rebels who defy the laws against cannabis and at least help those who are seriously crippled by horrible diseases...

THC4MS UPDATE!

As you may be aware 3 members of THC4MS are to appear at Carlisle Crown Court on Monday 4th December 2006 charged with conspiracy to supply cannabis, a charge that carries a maximum prison sentence of 14 years.
The trial is scheduled to last 7 days, breaking on Thursday 7th December for a day and then for the weekend and restarting on Monday 11th December 2006.

Mark Gibson, Lezley Gibson and Marcus Davies have been informed by the Judge and their respective Defence teams that they have NO DEFENCE IN LAW!
With this in mind it will be a very difficult task to persuade the Jury that they are innocent of any crime.
We are sorry to announce that in the event of the Jury returning a guilty verdict production and despatch of Canna-Biz chocolate will cease immediately and THC4MS will comply with the Judge's ruling whatever it may be.

A Croydon mum-of-two who uses cannabis to relieve crippling leg pain said she will be forced to turn to criminals after an organisation providing the drug free of charge for sick people was forced to close.

The 52-year-old became a regular user of the voluntary organistion Bud Buddies, which cultivated and provided pure cannabis for medicinal purposes, after it was recommended by a Croydon doctor.

Bud Buddies made cannabis creams, ready-rolled joints and capsules to post to patients free of charge.

However, this service is no longer available after its founder Jeffrey Ditchfield was given an 18-month suspended sentence earlier this month for a variety of drugs-related offences.

The Croydon mum has been smoking joints and swallowing cannabis capsules on a daily basis, supplied by Bud Buddies, to control near-constant pain caused by osteoarthritis in both knees as well as suspected multiple sclerosis and a brain condition which causes painful headaches.

However, she now fears she will have to turn to criminals to get a regular supply of her unorthordox painkiller.

She said: "I don't know what I am going to do.
This organisation was providing a service for sick people.
I had to get all sorts of documentation to prove I was sick before Bud Buddies would agree to help me.

"And the cannabis they sent was pure and had not been contaminated with anything "What people don't seem to understand is that to people like me cannabis is medicine.
I used to take a cocktail of conventional painkillers which, in the end, stopped working.

"Using cannabis allows me to function.
I hate the thought of going to drug dealers to get it but if that's what I have to do, so be it."

Bud Buddies, which was run from Wales, had stringent procedures in place to ensure only people with painful and debilitating illnesses could use the cannabis.
It also regularly reviewed and monitored every patient's usage.

Patients were sent pure cannabis through the post, free of charge, in either bud form, as a cream or in capsules and, like a charity, it accepted donations to fund the supply.

Mr Ditchfield has long campaigned for the class C drug to be available for medicinal purposes.

Cannabis chocolate trio convicted
Three people have been found guilty of supplying thousands of cannabis-laced chocolate bars to multiple sclerosis sufferers for pain relief.

Mark Gibson and his wife Lezley, both 42, of Alston, Cumbria, were standing trial at Carlisle Crown Court with Marcus Davies, 36, of St Ives, Cambs.

They were convicted of two counts each of conspiring to supply cannabis throughout 2004 until February 2005.

All three were ordered to return to court on 26 January for sentencing.

The Cumbrian couple admitted running a cottage industry making and posting out more than 20,000 Canna-Biz bars containing about 3.5g of the drug, to victims of the disease around the world.

But in their testimonies they both insisted this was a free service funded by voluntary donations, which was only available to MS sufferers who provided a medical note confirming their condition.

Davies admitted running a website and post office box, but had denied any involvement in making or posting the chocolate.

Cash receipts totalling £30,000 were seized by police, but the court heard Lezley Gibson told officers these referred to donations, which were ploughed "straight back in" to fund the Canna-Biz operation.

All three told the court they believed they had a defence of medical necessity in supplying the cannabis-laced bars, but this was rejected by the jury.

After the hearing Lezley Gibson said: "The maximum sentence for what we've been found guilty of is 14 years in jail. If you were a child pervert your maximum sentence is only 12.

"I think there's a mistake in the law, and I think they really, really really need to re-think the law on cannabis and medicinal use. Bringing ill people to court and torturing them like this isn't what you do.

"You look after ill people, and you try to make them better. You do not torture them and drag them back and forward to a court of law."

Seriously, most industrialised modern societies are merely corporate dictatorships marketed to the people as democracies. As long as the economic agents who intend to support the drugs war & prohibition directly or indirectly cling on to the clout they enjoy in decision making process- shock incidents like this will more sooner than later become something "normal" :yoinks:

We should either cut down, minimise or better yet- avoid- buying products made by corporations who have a vested interest in funding or endorsing the drug war & prohibition. We can maybe expand our growing activities to include other medicinal plants as well and maybe offer it to patients also? So that people have an alternative to buying from a pharmaceutical devil....I mean company- the major industry involved in endorsing the drugs war.
