AZ supreme court puts brakes on LEO's roadside tactics

No inchoate and unparticularized suspicion or hunches to search your car. The AZ Supreme Court has told AZ leos what the US Supreme court says is for AZ too. I don't know if this is anything more than just saying AZ cops have to follow the same rules or what. Also a shame the guy has to stay in jail even though his conviction was tossed.
(I actually think the cops knew what this guy had in his trunk already, but couldn't use their illegally gotten evidence, so tried the old 'the driver was nervous' routine to get the search.)

BTW, you are technically wrong in your post and title. The APPELLATE court tossed the conviction, and the county is considering if they will file to the AZ supreme court

So according to the LEO's refusing a search is grounds for probable cause then. What a load of horse shit. No wonder the judge threw the book at the prosecutor. As the article said if the LEO had suspicions he would have asked right away but did not.

Fucking pigs are getting bigger balls by the day.

i think they have a time restriction on how long they have to file the appeal before there LEGALY REQUIRED to release him.:jump:

yea man AZ is no joke right now. my homeboy got had with 300lbs of brick weed he had stuffed in car on trailer. they pull everyone over just for shits and giggles they are no fools down there. id stay clear of that state.

Because of the closeness of the Drug War and Mexico the southern states are becoming and will become more militarized.

That's why they call it War.

This is a good step. I imagine LEO will find another way to circumvent it though. They don't give a fuck down here.
