ARREST WARRANT

At least on this end of the country, many counties have searchable databases for legal infractions within that county. I don't know what the chances are of someplace in 'Bama being online with that information, but it would certainly be worth the effort to check into it.

That's right. You can go online and search the persons name. From there, you can find out about traffic tickets for sure, and probably outstanding warrants. Anyway a simple phone call to motor vehicle will tell him if it's a traffic ticket. Pretty strange if he doesn't know whether it's a traffic or criminal warrant. Something sounds "fishy".

I have never been to Alabama but I have been to Texas, if Alabama is at least half as bad then never go back. I dealt with warrants and being extradited numerous times over a twenty year period. Someone mentioned something about statute of limitations, believe me dude there is no such thing if they really want you. Hire an attorney being it a small town and you don't have a million dollar case it is possible to get from under it. And yes small towns usually defense attorneys do hang out with prosecutors they probably went to same schools. What you need to do is find out if it's a 1st, 2nd, or 3rd degree felony because each one has a different level punishment. You may find your particular crime may be able to be broke down as a simple possession trust its possible no matter what the plant count was with a good attorney. Google attorneys in that town and do research on each one grade school in particular. Google prosecutors find which grade school's attended. Try to find the ones who went to school together(trust you will find some) take that knowledge and use it accordingly. You will have more leverage if you hire attorney from that pool. Sounds crazy but I have been extradited numerous times and have used that tactic in small towns and it works most notably my 1989 conviction in Texas for possession of marijuana. That tactic got me 10 years probation instead of the 35 years prison time they were trying to give me, all because my attorney went to school and played golf with the prosecutor. Just my 2¢ coming from a person who's been thru it numerous times. PEACE!

You need to find the details of the warrant. Because some warrants range from local to national.

I have a friend thats in you same situation he went back home to stay with his family and is laying low. And hes actually using his brothers id. You can fly domestic without a problem as well.

best wishes

I remember a few years ago I had a warrant and the cops kept going to my families house. They were getting too close to my grow so I went to the police station and turned myself in. I kept trying to tell the cops that I had a warrant and am here and they kept ignoring me. I almost just left and said fuck it. In the end I spent the night in jail and they let me go in the morning for $45 and told me to go to court.

I have warrants in at least 5 states. It doesn't seem like it's connected because when I get arrested in my state, they don't send me to the other states. Must not be a big deal. I remember a warrant I had in Ohio. When I called a lawyer out there, they told me it would be much better if I didn't go back to Ohio every again unless I wanted to get at least a few years. He said he saw the judge put a guy in prison for stealing a bottle of perfume. I don't think I'll be back there.

how can he get a lawyer without money?

before he left Bama he does remember receiving a ticket for a lack of car insurance, but he doesn't remember going to court, so it could be a simple fix and not a shit storm... but his last grow attempt is still lingering in the back of his head.... it could be just a simple failure to appear!

how easy would it be to obtain a lawyer at SF rates? no ones working for free..

These man, there are many lawyers that will do it for tax write off. There are MANY liberal type lawyers
that would love to stick it to some fat headed bama prosecutor over a weed charge. If he spent a day
looking for a free lawyer in the bay he will find it.

Start with this-

http://alabamawarrants.org/

Find out what the warrant is about, go from there.

I would go back to Alabama definitely. It's not a big deal, and the cops aren't that bad there. Chances are they just want to talk to you and then you'll be free to go, it'll take like twenty minutes and then you won't have to worry about the job issues, being on the run, etc.......

>not serious at all, given the circumstances you definitely do not want to go back with a charge to, of all places, alabama.

Lawyer hired and hes friends with DA but all lawyers say theirs friends with the DA.. Its good for business. But, I doubt if the DA has that many friends, by definition the DAs jobs is to not have friends but to put everyone in jail. Its a conflict of interest.

If there's an arrest warrant, they will arrest him, book him into jail, and he will have to go before a judge to get bail (unless it happens a minor offense sometimes there is a standard bail amount, but he will still get arrested and booked). They don't issue arrest warrants just to talk to someone.

I'd have to say that he doesn't need a lawyer UNTILL he's been arrested.

If they want him and perspective employers have been checking his resume, they know where he is and can have him arrested, and attempt to extradite him. THEN he'll need an attorney. To fight extradition.

If the warrant is for a shaky case or a minor offense, they may not go after him at all.... just waiting for him to come back so they can pop him for free.

Out of state extradition is Expensive. In times of budgetary shortfalls they don't do them... period.

Want to be safe? Move as far away from Al as possible. Most shit has a statute of limitations of 7 years max. FYI. IIRC

Statutes of limitations, where they still exist, are usually limited just to charging someone, so you can't get charged for non-felony offenses years after the offense has occured. If this person has an arrest warrant, they have already been charged. Charges don't just go away because time has past, arrest warrants don't go away either, and felonies of any kind (not just murder et al) often don't have any statue of limitations.

Very true.

Also has he looked to see if he can see it online? Some states you can, others Not.

If they arrest him 'out of state', he'll only get an 'advisement' I think. No bail, is given if extradition is involved. Only a hold for extradition, at advisement. Different states have different rules for time limits on 'holds for extradition'.

And yes, they may have issued a warrant for J walking, to have an excuse to bring him in to question him. If the bust was of another person's residence, they May just want to see if he'll roll on the other person, to strengthen their case against the other.

However if this is the case they certainly will not extradite him, under 'normal' constraints...... the cost is just too great.

North to Alaska..... or West to Hawai. Or maybe the US Virgin Islands? Stray thoughts. lol

Yes, extradition is very unlikely. Sucks to have a warrant following you around, though. Some states have ways to force their hand. There are states that have mutual extradition agreements between them. Often those states will have laws where if, say, you're arrested in one and have a warrant in another, you can file with the court for a disposition and they either have to come get you within so many days or dismiss the charge, but usually that's of benefit to people who actually have to serve a sentence since the time range for them to get you is 1-3 months (in the states I know of).

This is how I thought this worked.....if I remember correctly from reading this years ago.

Either way...hope it all works out for this individual

In the past I have lived in Alabama and have to agree, it is a backwoods state...beautiful.....but backwoods for sure.

I wouldn't go back to AL. Fuck that. Stay on the run and start growing trees again. Why would he need a job when growing is your job.Certain crimes have certain amount of time to catch you before the charges go away. Usually 7 years. Maybe his crimes will fall into that category.

the statute of limitations is around for some things..
7 yrs sounds like it snype
its surely worth checking into
