On sunday night i was chillin at a friends house playing on the xbox & having a smoke. Around 9.45pm there was a knock at the door. My friend lives in a terrace house & the frond door opens in to the living room. My friend was expecting his cousin to come round & he never rings when he is about to come round, he just knocks & scares the shit out of everyone.
we both froze when we heard the knocking & my mate was about to call him on his mobile to see if it was him but then the window was then knocked on. Now for some reasson my mate opened the door, even though every part of him was telling himself not to. He opened the door & 4 coppers were stood outside saying they had a warrent for someone they were looking for, then came the dreaded words "I can smell cannabis, are you smoking cannabis in there?" For reasons i still cant work out hid the weed on the floor under a towel rather than sticking it down the back of the setee (aint hindsite a bitch!) I had no weed, but my mate had a small tub with about 2g of Hawaiian snow & 2g of Kali Mist & a very small jar of several lumps off bubble hash.
Now i could hear what my mate was saying & half what the copper was saying. My mate was asking who the warrent was for, but the coppers said they could smell weed & wanted to come in. When my mate said you need a warrent (at the time we both thought he did) but rather than explaining the law the copper just said he didnt need "fuck all, i can do what i want." Then i heard battons getting drawn & my mate been asked if he wants to do it the hard way. The 4 coppers martched in to the living room. They started asking where the weed was & we both said we didnt have any. Then one of the other coppers said he saw me, through the crack in the door, hide something on the floor & pointed to the towel i hid the weed under. Then the copper said pass me it or i will lock you up on remand. We both sat there silent & the copper picked up the towel & found the weed. He then asked my mate if he was growing it & then one of the others went upstairs. The next thing we heard was "Its a factory, 2 floors, about 20 plants, money too." The 1st copper then went upstairs & came back down & said we were both in deep shit. They then handcuffed us & put me in the back of a police car & my mate in the police van, neither of us though had been told we were under arrest or read our rights. The 1st copper, who did all the talking & was a complete ****, also told us he was going to go through all our finances since we left school & do us for every penny that we count acount for. He also said loads of shit to try to be clever in front of the other 3.
We were taken to the station & booked in. Apart from been asked if i understand why i was in there i still had not been told i was under arrest & still had not been told of my rights. I was then strip searched. (take your pants off, lift your cock & balls up, turn around & spread yourass cheeks & squat down & stand up 5 times) & locked in a cell. 10 hourd later i was taken for finger printing & picture then put back in my cell. At 9am i was intervied & only then was i read my rights. One of the coppers who intervied me was the arresting officer who intervied me just under a year ago when i got arrested for production of cannabis, he asked if i had been smoking weed, i said i had smoked a joint on my way to my mates, but didnt have any more, he asked if i was planning to smoke anymore that night & i said no as i didnt have any left. He then asked my why not as my friend had some. I knew what he was trying to get me to say, but no way was i gonna say i smoked any of my mates as that would get him an extra charge off supply added to his charge, i said no because i dont like thr type of weed he smokes cos i didnt like the buzz (i didnt think there would be any point in ssaying i am an indica man& didnt want to smoke any sativa`s. He asked if my mate was "criminally minded" i lauged & said no, then was asked what my mates house is like & does he live outside his meens & did he confide in me & did i know he was growing. No, no & no were my answers, i said i was not shocked that my friend was growing but not not supprised that he didnt tell me as he has been in trouble for it twice before & i have been done for it once before so i can undertand why he would be so secretive. (luckily neither of the 2 coppers interviewing me had been to the house cos if you went to the loo on the 2nd floor you can see through the open door of the bedroom & see his 2 grow tents & see ducting from the fan, which you could also hear plus you could see the light coming through the air vents at the bottom of the tent. Plus some empty plant pots in the bathroom give it away (especially as he has no garden!) After the interview i went back to my cell for half an hour untill i had to go see the nurse (which i hadn`t asked to see) when i asked how much longer was i going to be there i was told as soon as my mates intervies was over & they had decided what the charges were going to be.
Around 11am, 13 hours after arrest we were let out, i had bee refused charge & my mate was charged with cultivation of a class B drug & bailed untill march. We were told that the search was legal & even though they had no warrent they were in their rights to enter the house as they thought a crime was been commited.
Now my mate had £2285 in a shoe box upstairs, he asked his brief before the interview about the money & was told it would be on the property siezed list so my mate never mentioned it in interview, but when he was released & got the property sheets the money wasnt on there, the robbing bastards took the lot!
They also took his 2 day old 40" HDTV, xbox 360 & my joypay & 3 games, which both me & my friend said were mine but i didnt get them back, also i have not got my mobile phone back as it was on my mates shelf & was booked in with the stuff they took.
My friend also has had mental helth problems & can not be interviewed or strip searched without an apropriate adult, but they fucked up & strip searched him without one.
I am looking for anybody in England that can help us with legal advice. we were not given a proper explination as to why they came in the house, they stole over £2000 & conducted the strip search of my mate when they should not have. To top it all sunday was my birthday & my friends cat died on wednesday, its been a pretty shit year so far!
