Seems smaller than fungus gnats, very large population in dwc reservoir. Bti does nothing

Fruit fly, nothing to worry about, unless you have apples growing.

I think they make vinegar traps to catch those if you want. they should not be a problem to you, more like a bother..

I'm uncertain. Do you recognize what kind of fruit fly? Red eyes would be a sure identifier.
