Any of you guys sign a "no grow clause" on your apartments and grow anyway?

How did you go about decided whether the landlord was just covering his ass(rightly so)considering the climate, and whether or not they really gave a shit and would snoop around?


Basically all apartments in the Humboldt area require a no grow clause that I'm seeing online.
 
Wow,isn't that something! What are the penalities of growing even after you sign that? If it's something like having to move and losing your security deposit,that doesn't sound like much to me.

I've had good luck with some of the larger local rental companies. Some of the smaller rental companies are good, some will want to walk through every 6 months. I have friends that break down every six months and set back up, what a pain.

Hey, I'm a lawyer (not California), but if you sign a no grow clause in your rental agreement that's going to be enforceable, and you could get evicted. But as "bass ackwards" said, what is the penalty from the landlord? Of course you'd probably still have to deal with the cops and you local District Attorney! Maybe different if you're a medical user as far as the cops, but if you signed a contract with your landlord he could still evict you.

I checked my lease agreement over carefully, no mention of drugs, growing, mj or anything related, weird! I rent from a large property management company though, so count me as part of the 6-month breakdown club (SUCKS!) I get in two crops between inspections, but so far they haven't even asked to look at the building I use yet, but I'm out in the sticks and not in an apartment. I also have a medical prescription for every one of my plants, so I don't know if they could evict me for doing something legal (I haven't caused any damage, no drug trafficking, etc.)

Used to be folks sold property in Humboldt for no down, owner carries and no payments for a year, so you could get your first outdoor grow in and pay them a balloon payment then. Don't know if that's the case anymore but I doubt it!

now i'm out here and i am wondering, does anyone have any personal experience with an eviction on the basis of a medical grow (within the plant count. Okay, how about over it too)?

lawyers feel free to chime in. unfortunatly there most be a few ppl on IC with some experience with this. maybe in the

i am thinking that it would be cause for eviction and the cops would be called but would there be charges? if you're in a lease do you owe the rent for the rest of your term (one year... ouch.) Security deposit?

Growing in apartments in humboldt can be a bad idea. It's pretty common for the fire department to "inspect" apartment complexes. Had friend get his door knocked on at 8am to the fire marshall, he told them to come back later. 30 mins later the fire marshal brought the cops back with him. They took down 4 ops in one 20 apartment complex.

im in a similar situation. I built a wall in our basement, to section off a 12'X12' section. I am dreading an inspection, because I am sure they will want to see whats behind the false wall.. ( I made sure there is nothing that would need to be inspected behind it, only one pipe and a fireplace.)

As of right now, I am going to go get tomato starters and have them on retainer. That way, it looks like a legit vegetable grow.

The other idea was to call it a dark room, and build a bench to hide my RDWC buckets, put tubs of chemicals, and a red light. I think that would be legit enough to make them not ask any questions or search further.

At this point, im nervous as fuck for an inspection, and fortunately we have 48 or 72 hours before entry. I hate renting, its terribly inconvenient.

Yeah THIS. I don't see them going around to cancer patients houses and demanding to see their pill bottles for prescriptions, so there is a discriminatory angle you could play here. As long as you haven't damaged the room/house/building you are renting, and you're not selling/creating a public nuisance, etc... I would think the ACLU would be happy to help a renter out if they got popped for this.

Don't move into an apt in humb with a a no grow bit and grow. They aren't covering their asses, they have nothing to cover, they just don't want a grow. Go to the times standard or eye website and search on fire, explosion, property damage and shot and now you know why. You're not going to be pulling it over on them either - young single male fresh from outta state, they got your number. They will catch it. Property managers there have more experience than dea agents.

some real advice, not hating...

if you moved to cali to grow, get out of the eme triangle right now. It's full. When you get your rec make sure you get a doctor that will write it for a high plant count like 75. Now you can move anywhere and they wont have grow clauses or be suspicious. Stay out of the south, be smart and you're done.

If you moved to go to state, or have another reason you MUST be in humboldt, ok.

You can skip growing and buy $25 8ths in town anytime instead.

If you must grow and must live in humb your options slim. You can't use an apt. If you can't afford a house then see a) not growing

if you can afford a house, try getting a temp place to hang and not grow while you meet people and learn the land.

Make friends with a lot of people including older folks and you will very possibly meet some landlords. Make sure everyone knows you need a place. A ton of them smoke and some amount know they lease to growers. If you find one they'll understand what you're about, let them lead. Expect to pay a tax.

If nobody like that is coming along look carefully for a house. Never inside arcata or any other town. As country as you can, stay out of the housing developments. Most property managers will see you from a mile away, avoid. Ask to see leases early, many will have the same anti-grow terms, skip those. If you find a good spot make sure you have a job and pay with a check/cert check not cash or a MO.

When you move in, make sure to meet all the neighbors. Make sure the yard looks awesome. Don't black out the whole house or the obvious front windows. Don't damage the house putting in lights and vents. Do make sure all electrical is 110% electrician class work, no extension cords all over. Don't jump the meter. Don't burn down the house. Don't make BHO inside and blow it up. Don't let people know you grow. so that you. Don't get into a shootout on your front lawn.

That's it!

If you are still here, must be in humboldt, must grow, can't afford a house and refuse all other options, well. Sucks. You just found a harsher situation than you ever had at home, even though it's legal. You're kinda on your own there.

You do know that growing is still illegal under federal statues right? No way in hell you could sue a landlord for preventiong you from doing something illegal under federal law.

Since the new AG has been instructed to leave medical MJ states alone as long as they are complying with state law, yes, I think I could sue a landlord/property manager and win, but yes it would take backing from the ACLU and a good lawyer.

Good ol America, freedom and laws are just a question of how much money you have for a lawyer or three.

You could not sue a landlord for this. A lot of leases contain clauses such as no pets, no smoking, etc. As long as it doesnt discriminate based on gender, race or age they can pretty much put anything in there they like. If you don't like the language of the lease don't sign it.

Baddog is correct. Agreeing to not grow wouldn't be a civil rights violation.

To someone inexperienced using HID lighting could very well be a fire hazard. I personally wouldn't care as long as I inspected the set up before they started to make sure it was safe........

You're right Baddog40, I typed my response thinking that if I DIDN'T have a no-grow clause that I could sue if they tried to evict me for it, my apologies for any confusion. My lease didn't have such a clause, and I hope that most of our fellow IC'ers wouldn't sign such a thing!

But, it's 5 bedrooms for a grand a month, cash. Landlord is too busy to come around much, sucks for repairs, but makes life easy. I used to think he was really square, and then once the plumber was coming over and he called me and told me it might be a good idea to put away all my bongs. Every time he's been over the house has been spot-less without any paraphernalia in site. Apparently he just assumed and was correct. He knows nothing about the important shit though. Just keep looking, you'll find something eventually. It takes time and persistence.

i lived in other apt in fresno that had me signe some thing that sed i wont be doing drugs on the premises or selling drugs or have such animals like pit bulls and rots.. but not this one im in now.

Boy, that would make me nervous. If he WASn'T guessing, he has been inside your house and at least knows you smoke. Not uncommon in apartments for landlords to go through folks places when they aren't home. Maybe this guy is just stringing you along?
