3 Officers Indicted Drug Raid Shooting
Published: 4/26/07, 9:25 AM EDT

ATLANTA (AP) - A grand jury indicted three current and former police officers in the shooting death of an elderly Atlanta woman during a drug raid, a judge said Thursday.

Officers with a no-knock warrant had raided the woman's home without warning last fall after an informant said he had bought drugs from a dealer there. Kathryn Johnston, 92, died in an exchange of gunfire after the three plainclothes officers burst in.

The specific charges in the indictment were not announced in open court Thursday, but arrest warrants were issued by Fulton County Superior Court Judge Stephanie Manis.

Fulton County prosecutors said earlier this year that they intended to seek murder charges against officers Gregg Junnier, J.R. Smith and Arthur Tesler, who they said were involved Johnston's death.

Maybe they will rethink their no-knock strategy. You would have thought they would have known a 92 year old woman lived there.

That's one of my biggest fears. Not so much getting busted or whatnot. But fear of a No Knock warrant from hearsay probable cause.

The first weekend of this month, we had someone trying to break into our home in the darkness of night - while we were home. Not only were we home, but it was obvious that we were home. Nonetheless, whomever this creep(s) were tried to get in anyways. We discovered evidence of this on the back screen door. They had tried to back the screws out of the screen door to get access to the deadbolt. I assume, trying to pick the deadbolt lock and gain entry silently.

They had also cut the screens on my 8 year old daughter's windows, attempting to gain access via those windows - which were also locked.

Anyways - we were home. TV's on, everyone else in bed, except myself and one of the curtains in my daughters room wasn't closed all the way and the location of the window, you could see in the house and down the hall - seeing me move about, etc.. So whomever was trying to get in, was fully aware people were home and awake.

So you can see my alarm on this. Wholly shit, this wasn't a burgary attempt, they were trying to get in while we were there awake and no telling what they had planned from then. As they were trying to get in stealthy, most likely to get the jump on me and do unimaginable things to my family.

So, I purchased firearms (I no longer owned a weapon, as I had killed enough people in my life - I'm a vet) and then installed alarm systems, sensor lights and alarms, etc..

Anyways...the point I'm getting at is: I'm already armed and ready to blow away the first person the comes barging through a door or window. I mean, our safety has already been recently threatened tremendously by badguys. I am back in the awareness I was when I was in the Infantry in the bush. There's no playing around - there's no warning shots nor verbal warning. There is only shooting to kill. (My state allows me to do this, as well).

They really need to rethink this noknock warrant crap. Get extra officers and surround the property so nobody jumps out a window or whatever they're worried about that makes them think they're justified for a noknock warrant.

To any LEO: If you plan to bust me, get a warrant and knock on the fuking door. I will answer and read your warrant. If you DO have a warrant, I shall peacefully let you in to do your thing. DO NOT trash my house. Do NOT barge in, threatening our welfare. I am a peaceful man and would not resist you. I truly believe in fighting you in court afterwards - whether I stand a chance or not. I know confronting you will get me nowhere, but in more trouble. So it is safe to get a regular search warrant. However, a NOKNOCK WARRANT will be a bloodbath, as my first thought is NOT Police, but BADGUYS AND I WILL SHOOT.
I am not shooting to be macho. I am shooting to protect my wife and children from harm - please, please knock on the door if you come. (Don't come BTW - but if you do, frickin knock and I shall comply).

No knock?? Well, that is lame. You see, if anyone was to bust into my house without knocking they are going to get shot...even if they are a cop. Sorry buddy, but if ya don't want to get shot, then knock first. Blech, damn cops always exercising their power.

marx2k that was another case, the women was in her 80s, and they basically got the wrong house and gave the old women living there a heartattack in the process.

http://www.cnn.com/2007/LAW/04/26/atlanta.indictments.ap/index.html to the full story.

Was on cnn.com reading the news and there it was on the headlines.....fired me up all over again.
This needs attacked. Even if nobody gets hurt in such a raid......they tear the place apart and if they find nothing. Does the unfortunate home owner get reimbursed the damages? You know, we've all seen this on "cops" - bash in the door or two (sometimes coming in the back and front at same time. KNocking over things, breaking things. Then they do the search and rip the place apart - tearing things to peices in greater desperation when they are finding nothing. Once all this is over - then what?

Sorry, we destroyed your doors, a few lamps, and a coffee table charging in. Then during our search, we ripped out some walls, plumbing, tore open beds and pillows, etc.. This can quickly total up to tens of thousands of dollars quickly. On a warrant they got from some guy's hearsay that may be pissed off at you cause your lawn is nicer than his - who knows. People are that way. I'm not even counting someone getting killed over the ordeal - as I mentioned, most folks would shoot thinking they were getting home invaded by thugs.

anyways....I'm ranting over this again.....just pisses me off to all hell.

Hey Now, "mighty brave talk for a one-eyed fat man", Yea, blow those creepers away. Once the gun goes off the police will soon follow. Then they will enter your house, looking for suspects, no warrent needed, find your grow and ruin your crop. You might get lucky and shoot that teenager who lives down the street. You'll sleep real good knowing you killed the paperboy, that bloodstain on the porch will never wash off, and you'll have to move.

I say trust in Jah,live a peaceful life. It will payoff in the long run. I mean what exactly are you afraid to lose thats worth a human life? Get real man,
think of the consequences before you just blast away. :rasta:

Live in peace for a bountiful harvest! :joint:
