2nd Grow, 2nd Pull

I wanted to talk about this because it's angering, but I didn't really think it belonged on the growing forums or anything, so yeah...

So, I've had my second crop going for about a month now. The first crop I had I had to pull after 2 weeks because a friend got arrested, although we had no visits and he knew nothing about the grow, it was better to be safe than sorry. Now I've got this second crop going, was hoping to flip to 12/12 within a week or two and now, I find out tonight, that my lease (which ends tomorrow) is not going to be renewed. Apparently they already have new tenants and we need to get our shit and out. No warning, no nothing, and we're the only tenants that actually pay their rent on time. Probably the only tenants that actually expect her to act like a landlord too though. (We've been here since november, still don't have a working oven). So yet again I have to pull early, thank god these are bagseed and not expensive genetics, but still, 2 shots at growing and still no harvest.

yeah man that sux big time... I woulda taken the lease aniversary into account. I know I get 2 inspects a year and 1 is on renew date. so i work with that...

but I would be more pissed at having to move short notice... dont know bout your neck of the woods but a lock change is in order... a f$@k off letter pointing out notice periods would also be on the cards...

Just to let you know. Your landlord was to give you 30 days notice to move. Since they did not , it is an illegal eviction and you can sue them in small claims court. Also since the stove does not work you should not have paid your rent. And if you sue them you can ask the court to award you your rent money back for the months the stove was out of order. Do you have a copy of your lease? What does it say about non-renewal?
Sounds to me like you have what is known as slum lords that own the place.
And they will keep your security deposit. :fsu:
If I was in your shoes I would not be in a hurry to move. I would not pay rent and make them evict me. :wave:


P.S. To file a small claims suite cost about $16 usd. :chin:

Also if you have a camera take lots of pictures before you move showing the condition of your apartment as you left it.

thisbud is right. But, you have to keep the rent money in an account or something and it has to be a major problem.. No oven is a big one to me.

4. IF REPAIRS ARE NEEDED, WHAT SHOULD I DO?
An important court decision states that in each rental agreement
there is an implied warranty of "habitability" (i.e., a landlord must
put a building unto a condition fit for human occupancy). You cannot
sign away your right to this warranty of habitability. (Green v.
Superior Court (1974) 111 Cal Reptr. 704)

A landlord must repair all problems which fall under his/her
minimum obligations, unless the damages were caused by your lack
of care. A landlord's minimum obligations include that:

1. There are no leaks when it rains, and no broken doors or
windows.
2. The plumbing has to work, including hot and cold water, and
there must be a working sewer or septic tank connection.
3. The heater has to work and be safe.
4. The lights and wiring have to work and be safe.
5. Floors, stairways and railings have to be in good repair.
6. When it's rented, the place has to be clean, with no piles of
trash or garbage and no rats, mice, roaches or other pests.
7. The landlord has to provide enough cans or bins with covers
for the garbage. (Sec. 1941 of CC)

If you have problems with any of the above, the law says that
you should take each of the following steps:

1. Inform your landlord about the needed repairs, making sure
your landlord knows exactly what is wrong. You may do this
orally or in writing, but written notice will offer you better
protection.

2. Wait a reasonable amount of time for the repairs to be
made. "Reasonable" depends on the circumstances. If you
don't have heat in a cold month, you only have to wait a few
days. The law says that 30 days is "presumed" to be
reasonable. This means that if you wait fewer than 30 days
and the case goes to court, you must prove the shorter wait
was reasonable.

3. If the repairs are not made by the landlord within a
reasonable time, you make have the made yourself. Keep a
record of the costs and then deduct them from your next
rental payment. Or you may move out and not be responsible
for paying any more rent.

If you make the repairs on your own, the cost you deduct can't be
more than one month's rent, and you can't use this right more than
two times in any 12-month period. (Sec. 1942 of CC) You cannot give
up your legal right to repair and offset (deduct the cost) unless your
rent was lowered because you agreed to do things your landlord
normally is required to do. But if you made such an agreement
under pressure in order to get your place, the agreement is not
binding.

You may try another approach to get your landlord to fix the
problem. If your place does not meet the required standards of
habitability, you also could stop paying rent until the needed repairs
are made. If your landlord takes you to court, you can argue that
you have the right to withhold some rent to get the landlord to make
repairs. However, you should talk to a lawyer before withholding
rent because this is a complicated process. If you withhold some of
the rent, you probably should also deposit it into a special "escrow"
account, to show that you are willing to pay the rent if the landlord
makes the repairs. A special savings account or an account set up by
the court are examples of a special account.

Thanks everyone. Well aware I rent from a slumlord, but we pay the price of a 2 bed for a 3 bed house. It was worth it deal with shit. Unfortunately now we have to compete to find a place when all the college students are moving back into town (we live in a college town, pop increases about 15000 people during school, in a town of only about 40-50000). It's all very frustrating, but we fortunately have good friends. I found out today we have until sept 1st to get out. I thought it was august first because that's when our lease formally ended, but she's giving us our month now, so we have time, but it ended up ruining a lot of plans. Again, thanks everyone, stay safe.

Oh yeah, I can't just move them because it's a very risky proposition, and it's just not worth it to go to jail, plus, we've managed to keep the grow from all our friends already, and so to bring the plants into their home while we crash there would defeat that security measure that we've endured many many many questions to keep. Not that we don't trust them, but you guys know how it is. Loose lips sink ships and all that.

So, now that I've gone through pulling all the plants and we've been stressed about moving, all of a sudden the land owner shows up. (The land owner has been having another person manage the properties, but she's taking them back over. Landlord was probably stealing money.) Says she never told the landlord we needed to leave and that we had precedence over anyone wanting to rent the place cause we've already been living there. So now we have a lease directly with the landowner and our oven problem is already being sorted out. It's really great and it's relieved a lot of stress, but now I really regret not waiting to pull the plants, eventhough I think it was the right thing to do for security purposes.

So I'm setting up to start again now, and I want genetics this time, I've had two grows of bagseed that I wasn't able to finish and when I have my first harvest I want it to be wonderful weed, not possibly junk because of bad genetics. There's only one problem with this, I can't obtain a safe address, in order to do that I would have to tell a friend about the grow. While I do trust them, we all know the rules and sayings. We do however, recieve a lot of mail at our house for other people. I'm wondering if anyone thinks that simply placing the order in the name of one of those people would be safe enough?

Ah I wouldn't have pulled them, I woulda moved them outside. I don't know where you live, but even in New England you got another month and a half of growing time left...oh well, better luck next time.

Edit: I wouldn't order directly too my home. If you order from Gypsy or one of the other respected seed banks whatever house they are shipped too will have no clue what's in the package. You could always tell a friend that you're ordering something for your wife/girlfriend but don't want it to come to your house. As long as they're good friends that aren't nosey (As in they'd open the mail) you should have no problems.

So the packaging is completely plain with nothing on it even relating to the name of the seed bank? (I'll be ordering from sb)

Well I haven't ordered in awhile (I made seeds of my own) but that's how it was, you could always contact Gypsy and ask him yourself how they'd be sent. You have to realize that the seeds are being sent through customs, so unwanted attention is a liability to him. He wants your seeds to get too you as much as you do.
