2 ?'s. "More than likely" outcome; also police pull-overs

K

KMK0420

more than likely outcome..

i mean,

i need some worst-case scenario's here..

i'm in PA. with current state laws, according to normal (conditional, mandatory, drugged driving).

In other words, one of the "worse" states with weed laws.

possession of ~1 oz, $500 misdemeanor

cultivation, 5 years in prison, $15k fines.

yeah, lame... i know. that plus annoying room mates, security = major issue. i don't want my life ruined over something so fucking illegal (the prohibition of cannabis!) telling me i can't smoke or grow a plant, that God put here, it's a victimless crime, it's safer than alcohol i mean shit! its hard NOT to want to grow/smoke it.

in a realistic situation, if somebody saw or knew about the grow and called it in to police, what realistic (not theoretical ideas, please some straight forward getting-fucked-by-police-as-usual) situation would play out? IE expect a raid, everything confiscated, life ruined? or would they have to play it safe, and make some bullshit up to get a warrant? ive seen "anonymous tips" as "excuses" for police to get warrants. is this true? how do you avoid this, especially if someone you know sees the grow and or runs their mouth / gets yanked and turns?

Also on pull-overs...

I was thinking, if a cop pulls you over for some bullshit (which most is), and you are cooperating, would it be wise to tell the cop you have cameras and microphones in your vehicle? i've seen some police videos where, when the cop didn't realize he was being filmed he was a complete asshole jerkoff cop tryin to screw with some young kids life for a simple traffic stop...when he realized, his demeanor COMPLETELY changed and the kid was let go fairly shortly after. I'm thinking the cop has no legal right to stop the filming, so wouldnt that be something to mention to a cop whos going over the line?

Actually 5 years ain't bad. But if 5 years is mandatory, then if i decided 2 grow in that state i would grow as much as i can if all cultivation is charged with the same sentence. I mean if you get 5 years anyway y not go as big as you can. Personally i've had many friends get pinched in Philadelphia and Pittsburg on a number of crimminal charges and got much lighter sentences then my friends in Jersey get. Also even if you get a 5 year sentence mandatory minimum you could still get out on ISP probabily. I had a friend that was given 4 flat in PA and he was out in 5 months on ISP. If you have the cash to pay a retainer for a lawyer you can get a very reduced sentence especially if you are a non-violent 1st time offender. But in PA if they can prove that you have grown and profitted of of the plants more then one time you will get charged with "operating an on-going crimminal enterprise", and you'll wish you had that 5 year mandatory minimum instead haha. You can easily get hit with 10 years for that. But if you get a flat sentence, Meaning if the judge sentences you to 10 years no 85%. Then you have a good chance getting paroled or put on ISP very early in your sentence. But again you must not have any prior convictions, or they can hit you with the "habitual offenders" charge and all sentences will be more severe. If you have any other questions ask. I have a decent amount of knowledge of all the northeastern states laws and penalties. I know a few people doing time in those areas. From Povidence down to Philly. And as far west as Pittsburg.

Also forgot one thing. NORML is a great site to get refrence from. But don't look at the penalties llike they are set in stone. It's much better to look at court documents and actual cases. If you talk to a lawyer he will have much more knowledge of actual sentences given and not just what the law says on paper. He can also find other attorney's strategeys in getting around some of the laws. The key is to find the top guy in your area for the amount of money you have to spend. Invest in a lawyer! Nothing is more important then that.

Holy Cow. Another perspective than 79tc.. 5 years is a BAD! If you are talkinig about your own situation, you would have to be stupid to keep growing. Stop, change your situation, as in move, then once all this is a memory, start again. Ive been growing since the 70s and I dont know anybody in prison and my goal is to keep it that way. You do that by being smart... you ever watch cops? its full of dumbshits begging to be busted because their silly desire to do something is stronger than their common sense... its all up to you.

u ever realize the more harsh/illegal the laws are in an area only means theres more money to be made there. the price of the product is more because of the risk, and theres more people willing to take that risk in this crappy economy. nobody is thinking, wow this is really bad if i get caught.. i better move to a lighter sentence state.

make it legal in your state, and people will move out!! lol.

Trust me not only stupid people go 2 prison. I've seen some very well connected, and smart men get huge sentences. It dosen't mean they were dumb, it only means that they were investigated. Once you are under investigation the clock is already ticking, there gonna get you no matter what. Every once in awile you get a favorable jury and get charges thrown out. And then they come back and charge you with something else. It's all in the game. Now i will admit some people don't know when to say "hey i better get outa here and do something legitamit". But all i am saying to KMKO420 is that it helps very much to already have a lawyer paid to do some damage control. Now yes ideally he could just shut down and move to Montana or another Middle-America no name state. But if he does decide to take the risk its very important to be prepared for your defence. I mean his best bet is to not do anything illegal in the 1st place. I don't do anything illegal, i have a good job and i'm happy. But i have known some people who have done there share of shady business and i know that it never hurts to prepare for the worst...
